Our case was transfered to California like some of you.... but I was interested to know if anyone has noticed a "pattern" of which applications are approved without an interview.

My husband came in here with a K-1 Visa, we were married within the required 90 days, and never had to provide them more evidence.

He received his employment authorization already and the I-485 was received by Chicago on the 3rd of April.

There doesn't appear to be any rhyme or reason to the approvals out of California.

Hopefully, you will get lucky and be one of those that don't have to go to the interview.

I don't think anyone really knows why certain cases are approved without interview. Since you are not required to send any evidence of your marriage with the AOS application, there really isn't that much to differentiate the individual cases. It does appear that most CSC transferees are those adjusting from K1 or K3 visas. Those individuals have already been through a consulate interview where their relationships have been scrutinized and thus may merit faster approval. Then again, not all K-visa applicants are approved in this fashion, so we can't generalize like that.

Awesome post and you nailed it with the $1 million question: what is the criteria?

That's what everybody wants to know. There doesn't seem to be much rhyme or reason but, then again, no true analysis has been done. If we had a nice big database full of some good immigration-related metrics, then we could arrive at some conclusions. Unfortunately, there isn't one.

So, in the interim, we have a lot of guesswork accompanied by equal measures of caveats. I do think we can make some sort of educated guesses:

- If USCIS is not interviewing, then the case must be fairly straightforward. Would they give a pass to someone with a complex case? I doubt it.

- So what defines a straightforward case? Who the heck knows. My guesses: no children involved, no red flags, first-time applicants, no income-related issues for sponsor, filed everything on-time. Plain-vanilla stuff.

- Having said that, everyone feels the need to throw out their caveats... so here's mine: divorced couples, couples with children, and those with co-sponsors get approved without interviews. So there are no hard-and-fast rules here... and there's the rub.

I can only attest to my own experience. For me, our AOS case is plain-vanilla and it was transferred to CSC 6 days ago.

I'm figuring the plain vanilla ones are handpicked too and sent over there. A 5 minute scan of the application should be enough to determine which is vanilla. It also seems like they are sending over all of the cases that will have to adjust in 2 years - giving them a chance for scrutiny in the future.

I'm just hoping mine falls into this category - it fits all of your mentioned "criteria" except that my husband is adjusting from an F-1 visa.

no removal of conditions here needed in 2 years....and there are children involved.....so who knows! :blink:
