Hello

I'm sorry if this is obvious but I want to get to a point I'm 100% sure I'm right about everything that goes on the forms. We both reside in the UK, are married and are about to submit the I-130 through DCF in london.

On part D - Question 2 (previous petitions for the alien) what sort of answer should I give.

My wife (USC) had previously applied for an I-129F for me in the states. We eventually got this from our lawyer.

Enclosed please find a copy of the Notice of Decision I have received regarding the petition you filed for <name>. As you know, they denied the petition. USCIS indicates that they never received the additional evidence that we supplied them.

We decided not to appeal (motion to reopen) at the time.

So firstly - do we need to list the I-129F in section D of this I-130 and secondly if we do what do we list the previous application as ?

On part C - Question 14 and 15. Am i correct in assuming that 15 is only where I am currently in the states and they don't want any arrival information if I've only visited previously?

On part C - Question 19 (relatives address abroad). I'm sure it is obvious but the question seems to be superfluous as it will be the same as either B2 or C19. Is this just an option to have a different mailing address or if you aren't cohabiting?

Part D, Q2) YES, I-129F filed xx/xx/xxxx (provide needed details)

Part C, Q14) Not applicable as the alien is not currently in the USA

Part C, Q15) Not related to Q14, just answer the question

Part C, Q19) Just put in your address... Not everyone who prepares this petition has the USC living with the alien. Remember B2 is about the USC, If the USC was stateside then B2 & C19 would be different. In your case C2 & C19 will be the same. If you were an alien who was in the USA then C2 and C19 would be different.

YMMV
