This cant be good...(new I20 and I131 not done yet!!)

2 questions here......

Im an f-1 student btw...

Sent in i485, 765, 131, 130, 695...

I got a NEW i-20 today...this is my third. First one had wrong miajor, had to change it so I got a new one. And that one i sent a copy of to USCIS chicago. I DID NOT send in the FIRST i-20 i had.

Now the thing is, I had to move 3 months ago and therefor transfered to another college, and Today i got a NEW i-20.

So now I have 3 i-20's. 3 Different majors, the second one only one USCIS has. Question 1, should I send in all 3? Last one? or let uscis have the second one I sent?

Question 2

The package was: recieved 4 dec 2009.

Day 25 All forms touched

Day 15 got letter about bio

Day 26 about I-485 they requested a copy/translated original birthcertificate

Day 31 Bio DONE

Day 40 requested a copy/translated original birthcertificate RECIEVED (they probably put things on hold from the day they asked for it until they got it, so maybe i lost 40-26 = 14 days because of this)

Day 41 I-485 touched

Now, from how this is going..I'm going home to Sweden (from LA) to see my family for 2 weeks 26 march. Now HOW are the odds guys? that my I-131 will be aproved before 26 march? Its the 53'rd day today.

Bein from iran and all..heh not the most popular place right now so...specially if u´r a f-1. Anyway...eventhough the i-131 wont be aproved BEFORE 26 march...is there anyway i can travel anyway for 2 weeks without it affecting the application ANYWAY at all WHAT so ever...?

Do not leave without the AP.

If it's an emergency - you can make an INFOPASS with USCIS and get a expedited one.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

When I applied, I never submitted a copy of my current I-20. At the interview, the DO just went out of the room and made a copy of the most recent one. She was not interested in the prior "billion" I-20 I had in the past.

AOS Approved on 10-17-08 (details in profile)

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.

And what reason should I give? Only emergancy is that I miss my family and haven't seen them in almost a year..... :/

This is unfortunately not considered an emergency. I would forget about the travel plans until you have your permanent resident card. If you really can't wait any longer to go, at least wait for your AP. The emergency AP is for real emergencies...like your close family member dies and you have to say good-bye.

Oh m god really? We already got

the tickets and all.

So we can't get a infopass cause it's ONLY for emergency...

Only way is to HOPe to get it approved.

Must be a way to speed it up though?

If I send in something, so that the person takes care of the case have no choice than lookin at the whole thing, cause the documents haven't been touched/updated since 28 dec 2009 (well the 485 14 Jan)

or maybe I can send in a letter asking if it's possible I can get it

approved sooner?

Btw I heard eventhough u have a AP it might affect your aos negatively And u might get denied reentry!!!!!!!

Is that true? :S

You can make an infopass at your local USCIS office now. Bring in the flight itinerary/tickets and ask if they can work on getting the I-131 approved. While you wouldn't be able to get an expedited emergency AP, you may be able to get them to process the I-131 application you currently have in progress so that you get it in time for your flight. Generally APs are expected to take no more than 90 days which leads to early March so it isn't an unreasonable request and it is worth a try. Good luck.

Ah what I relief...

Ok me and my wife just made an appointment at the uscis. So I'm gonna take your advise thank you.

Last time we were there though the person mentioned it's only for general questions, are u sure the person we will talk to at the uscis have the authority to look in to my files make decisions etc etc?

Overall sounds like a very good idea. I'm jus worried they will be harder since me

bein Iranian...

Anyway Kathryn, is it true eventhough AP is approved, it might affect your aOS application negatively IF u leave the country a while?

Using the AP should not have an impact on your AOS unless you have out of status days in the US. If you have 180 out of status days then you would be denied re-entry even with an AP and barred for 3 years. If you have a year of out of status days, then you would be denied re-entry even with an AP and barred for 10 years. If you have no out of status days, then using an AP should not affect your AOS application negatively.

If you leave the country for a long while on AP then USCIS might question whether you are really planning on living in the US which is what the purpose of the AOS is, but for usual visits or family emergencies that are not unreasonably long in duration, it should not be a problem.

One thing to remember - when you use an AP to return to the US you are being 'paroled' back into the US which means that while you are physically in the US, you are in a different status as a parolee than you are if you never left. It shouldn't have any impact on you but it is something of which to be aware.

Hopefully you won't have any problems due to your nationality :). You will speak to an immigration officer at the Infopass. Bring along your identification, your passport and a copy of the receipts for the AOS, AP, EAD - whatever you received. The officer will be able to look up your file on a computer using your A number. If there is a problem he/she should be able to let you know. If the AP has already been processed, he/she can let you know; if the AOS has been processed, he/she can let you know. While they won't have the authority to make a decision, they can do follow up and add information to your file. You are not asking for an emergency AP; you just want to do what you can to make sure the regular AP is approved before you need it. She/he can certainly put some type of action request on your file to see if that helps.

I just want to reassure you that having no touches on your online status isn't a reliable standard to use. USCIS is very inconsistent in updating files so having no touches isn't anything to be concerned about.

Good luck. I hope your infopass is useful and that you receive good news soon about your AP and green card.
