HELP! I'm so Consufused!

:help: After my husbands petition is approved, and sent to the NVC, approximately how long will it stay at the NVC before being forwarded to the brazilian consulate in Rio? And when it's at the NVC, what do I (the USC) need to do, fill out, send, etc? And/or what will my husband need to do, fill out send? Or will it still be just me filling out paperwork for the NVC...? And when/where do I include all my financial information for sponsorship? Is it here at the NVC?

Then once it is forwarded to the NVC, what exactly are packets 3 & 4? Are they sent to me or my husband? Will my husband be responsible for filling out everything and sending it back to the consulate?

And please don't send me links to read the timelines or flowchart. I've already done that. But i'm still confused. thanks. :unsure::help::wacko::huh:

I don't understant? How are we BOTH supposed to fill it out, if I live in the US, and my husband lives in Brasil? Am I supposed to have him fill it out his portion, then pay a million dollars to have it next day air from brasil to US (Which actully takes like 3-4 business days), then pay another million dollars to send it back to him, next day, then have him pay even another million dollars to next day it to the consulate in Rio? :wacko:

The old 'packet' terminology doesn't work so well for the immigrant visas any more.

I will try to help you with some of your questions.

After the I-130 is approved, the first form to come to the USC will be the DS 3032 where you will tell them where to send the rest of the forms. We have a lawyer so we did not get this form. The forms to fill out will come to whomever you name as the choice of agent, most likely the spouse in the US, in our case our lawyer.

The first forms that our lawyer got were bills. 2 separate ones that had to be paid with money orders or cashiers checks, one for the 230 and one for the 864.

After the NVC received our money then they sent us the DS 230 and I-864 forms. You can download the ones from the website and get the information that they will need here:

You need income taxes, etc. all the financial stuff for the I-864.

For the DS 230 you need all the places that your spouse has lived for more than 6 months since the age of 16, where they went to school, their parents information, all the places they have worked in the last 10 years etc. The forms are quite easy to fill out once you have all the information from your spouse.

So you need for your spouse in Brazil to give you all of that information and then you can fill the actual forms in when you get them here in the US from the NVC.

So one person can do the actual filling in and sending back to the NVC, but the person who fills in the forms will need information from the spouse that is in Brazil. I think that is what they mean when they say you and your spouse will fill them in.

After you send all of this complete information to the NVC and they are satisfied with all of your information then they will send you a notice saying case complete. Then the NVC sends it to the consulate in Rio. Then the consulate in Rio should contact the spouse in Brazil with the interview information.

Be aware though. We did both the I-129 and the I-130 for a quicker interview because we will need the I-601 because of a previous tourist visa overstay and so we had to go to Rio to be fingerprinted before they would let us do any of the packet 3 stuff. The letter telling us to come for the fingerprints in Rio was received on Friday night in Roraima with the appt in Rio for the following Tuesday.

Also no one contacted us to tell us that we had an interview scheduled for the I-129. We did not get a packet 3 or anything else. We found out that we had an interview scheduled when we emailed them to ask if the fingerprint results were back yet. We found out at that point by their return email on Monday, July 3rd that our interview was scheduled in Rio for Wednesday for the following week.

I hope this helps you some with your questions.

I understand about having to send things back and forth from Brazil. It is quite expensive and takes such a long time. We have not found a reliable way to do it. We have found Sedex to be our best and it is very expensive and takes about 10 days to receive from Brazil.

As you say you have looked over the NVC Flowchart. If you noticed there is two paths. But by making the USC the choice of agent, everything goes to the USC. The only form that is needed to be completed by the beneficiary (now the applicant), is the DS-230. You can have your spouse download, complete and sign a copy of the DS-230 part 1 & complete part II if required (see the links below). Part II should not be signed. Dont date either of them either as you can do this prior to sending them to NVC when requested. Have your spouse forward the DS-230 to you way ahead of time, along with any documentation that is required depending on country.
