Just recently my wife emailed me a copy of a form that the embassy gave her, which expressed ""Form I-134, a current job letter from my Williams-Gonzales employer, and proof of Active Military Status.

I sent her the following forms:

1. I-134 form filled out (it even has the form # written on it)

2. My most recent W-2s from my employers US Army and Williams Gonzales

3. Photocopy of an Active military ID

4. Job Letter from Williams-Gonzales

5. US Military orders from 2009

When she goes to the embassy to turn these forms in, she is told that none of the forms she provided was correct, not even Form I-134 that has I-134 legibly on it. To be sure, I sent her the exact same forms and again she was rebuffed.

How to proceed?

First, your profile says you filed for a K1, but you said your "wife". Is this a K1 or spousal visa?

Assuming it's a K1, did you send her an original I-134 bearing your signature, or did you send her a scanned or photocopy? Consulates almost always require an original signed copy of the I-134. In addition, they usually want a copy of the tax return to go with the W2's.

A current LES should be sufficient proof of your active military status. A letter from your CO or base personnel office, on official letterhead, should also work. Honestly, I'm not sure what else you could get to prove active military status.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

I sent them an email this afternoon at 3pm EST, and they responded to me at 845am their time..... So I got a response within 6 hours. Cool, it worked out.

Dear Mr. XXXXXXXXXXXX,

I apologize if your fiancée did not understand the reason why the consular section was not able to issue a visa to her yesterday. At the conclusion of the interview, your fiancée received a letter outlining the remaining documents needed to continue processing the visa request. In particular, many of her original documents have expired in the year since her last refusal. The remaining documents are:

-Evidence of how you and your fiancée have maintained your relationship since 2008

-Form G-325A for both you and your fiancée

-A new, valid medical exam

-A police record and English translation of the police record

-New visa photos

-Forms DS-156, DS-156K, and DS-230

-Your fiancée must pay a new MRV fee of $131 because it has been more than a year since the previous refusal and the consular officer had to revalidate the petition because it has already expired.

Your other financial documents are acceptable. Your fiancée may submit the requested documents on Monday or Friday at 8:00am.
