I am an LPR, finishing college in the Philippines in two months. While studying here, I got pregnant and gave birth here. Now that I'm about to finish and move back to America, I want to petition for my daughter too. She's only two yrs old and I can't just leave her here. Her father and I are not married. We broke up. How long do you think that will take? :help:

For a LPR it takes about 4 years to bring a minor beneficiary from the PI

Thank you. Is that the minimum number of yrs for waiting period? No way it could be within a yr, or even two?

Your child is/would be considered Family Preference 2A.... The queue is full of previously filed petitions that are in line ahead of you waiting for an available visa number.... Not possible to "jump" to the front of the line unless she changes preference category.... The only way to change your preference category to one that is faster is to have, for example, a USC spouse be the petitioner....

follow the link and look under Family 2A ... they are currently processing petitions filed in March 2006

The wait is 4 years -

You would fall under 2A

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

How long have you lived in PI as a LPR?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

on the surface the math would indicate somewheres close to three years (two year old child + 9 mos. pregnancy + ????)... which may be problematic in and of itself....

Concur - ironically, I was talking about this post with my buddy and his first question was "how is she maintaining her LPR status?"

That's why I asked. If she hasn't returned to the US during that time she may have lost her LPR. If so she obviuosly has a huge problem.

I guess the father wasn't a US citizen.

Need more info from the OP to help her.
