I have an appointment for visa interview on February 7 (i-130) and march 5 (i-130), a new case and a case which was once denied also approved respectively. Since we already celebrated our second anniversary we expect IR1.

If I leave the 2nd interview and have the first one only there are original documents attached with it. Again i do not know wheather it is possible or not to joine two cases, but if done I am going to have 2 birth certificates (the details are same). realy i am very much confused. Please help

I don't understand how you can have 2 live petitions at the same time. How was the march 5 interview visa denied and then approved?

We need a bit more background than what you've given us, including details of why the first petition (with the later interview) was denied and how they turned the decision around.

Where are the interviews taking place?

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

I don't know what you would do in this case, but to clarify...

Was the first case sent back to USCIS and they reaffirmed the case?

The first case was denied due to insufficient documents that verify our marriage is factual. However, we told as denied cases took for about two years as a result my husband applied for another petition (he told one can have more than one live cases).

He is asked to proof the denied case. Then, through lawyer he did then the case is re affirmed. Unfortunately the interviews are scheduled with a month difference.

He is asked to proof the denied case. Then, through lawyer he did then the case is re affirmed. Unfortunately the interviews are scheduled with a month difference.

Was it denied or was a request for evidence issued? Sounds as though you were given the opportunity to give more evidence, which you did, and they were then satisfied. This means the second I-130 is proceeding unnecessarily.

I don't know if anyone has experienced this and can tell you whether the second I-130 will now supercede the first one. Did the lawyer advising you know that you submitted a second I-130?

You need to talk to the USCIS. Can your husband make an INFOPASS appointment to discuss it with them?

what is an INFOPASS appointment? Actually, the lawyer advised him that, just have the first interview and if they are asking too much told them as the approved rfe is reached there. (embassy)

I wish you the best of luck with this. I don't know why the lawyer had you file a new I130 when the first one wasn't completed.

If your SO is lives close to an immigration office, I would have him make an infopass appointment.

I don't know if calling DOS will help, but maybe that is another option.

Timeline

The USC was responsible for getting the original documents INTO NVC during NVC processing, so I don't see that you have any issue for 'original documents' .

Just to be safe, though, bring another set of original documents with you.

As for 'which interview to go to - hey -

go to the first one, see what happens. Just make sure the police clearance certificate is within 1 year of the interview date.

i did go for the first interview and then got the visa. the consular advised me no need to be present on the second interview date. since the embassy didnt have the 2nd case / file during the first interview, he advised me to claim original documents from US.

Praise the Lord!
