WOW!!!!! this is strange........i went back to NVC website site and check on payment status and in the invoice tab it shows AOS not paid, but when I go to the receipt tab it shows in process and it gives me a transaction ID number. I am going to wait until later on and check if any changes.

Wait a few days and see if the status still shows NOT PAID... I'm assuming by this time the funds have been taken out of your account. Did you pay your IV Fee bill online before NVC sent an email asking you to pay??

Ohmygoodness!!! My DS3032 got accepted! Yaaaaaaay. I just got the email. I'm so fricken excited. E-mailing it earlier on January 30 paid off. Hahahaha.

I usually file as Head of Household since I support my parents here.

I wonder if I would be able to include my wife on it that way since she does not have a SSN. But the IRS will provide you with a ITIN if you submit a IRS form W-7 which is an application for ITIN for non-resident alien.

Suggest you file a paper return, 'married filing jointly', get a w-7 form, file all to the address in Austin.

actually, i received an e-mail from NVC requesting me to pay both bills so they can proceed with my case. I had a lawyer submitt the I-130. Sachinky told me that by having a lawyer submitted the I-130, i skip th ds-3032.

I did this on Year 2007 taxes and we got married in November 2007. I left the SSN number blank on the 1040 and filed the W-7 at the same time. I did this at our local IRS Office so they would stamp the return with the date/time of filing. The local IRS office actually did the mailing to the Austin office for me. I did lose the "Stimulus $$$" that year because my wife had a TIN (Taxpayer Identification Number) not a SSN. Even tho I had custody of my 2 children from my previous marriage.

Not sure if this has been answered for you BUT you cannot claim Head of Household if you are married. The W7 can be completed but the ID requirements need to have an apostille to verify the documents. The easiest is a copy of her passport because then that is all she needs to submit with it. If she comes from a country which is not a signatory to the Hague Con. then she needs to have her ID verified by an American Embassy/Consulate in her country.

You submit the W7 and all ID requirements with the 1040. You can't electronically file if you do this unfortunately. 6-10 weeks for the TIN.

I have just been through the apostille process in Australia. $105 for a public notary to authenticate and $60 for the Dept of Foreign Affairs to certifity it with an apostille. Hope this helps.
