I-864 vs I-864EZ

I am review and the AOS filing instructions and i have a questions:

1. Currently I have I-864 completed but I meet the I-864EZ criteria. Should i file I-864EZ.

2. Are there any advantagse/disadvantages to filing the I-864 vs. I-864EZ

3. When assembling your AOS package, is it OK to use this folder? I can separate all the different documents into different sections.

i didnt write our case number on the originals. i put a post it note (with our case number) on all the originals

GOOD idea! I will do that...

Okay, it's Tuesday and NVC is open! Let's go, go, go. I want my L-O-G-I-N F-A-I-L!

How're you guys getting through to NVC and more importantly, through to an operator? It's either busy or when I finally get through, I'm on hold for ridiculously long stretches.

I was on the phone for 20 minutes last night until I got an operator and he was ABSOLUTEY NO HELP AT ALL. and rude!

--MrsW--Good luck. I hope the attorney convinces your FIL that the joint sponsor thing is not that big a deal.

--Melody--Employment letter is optional. If you don't have it, you don't. Just send copies of your dad's paystubs for the last 6 months.

--DS230 Packet

Barcoded cover sheet for IV bill of $400.

Two (2) Passport Size Photographs of Beneficiary (NVC Case Number, beneficiary’s full name, and date of birth are written on back of both)

DS-230 Part 1 completed and signed by beneficiary

DS-230 Part 2 completed by beneficiary – unsigned, as of yet, per instructions

Photocopy of the Biographic Data Page(s) of Beneficiary’s Passport

Original/Certified Birth Certificate of beneficiary (with an attested translation provided) and a copy

Original/Certified Marriage Certificate and a copy

Original/Certified Passport Office Police Certificate for Beneficiary and a copy

Original/Certified Police Clearance Certificate and a copy.

--Folks, remember these tips regarding the AOS: The primary sponsor irrespective of income must fill in an I-864. If your joint sponsor resides in the same house as you, then they will fill in an I-864A. If they live in a separate household, then they will fill in an I864.

If they are filling in an I864A, please remember to include proof of same household/relationship.

If they are filling in the I864, please attach proof of their residence or citizenship. They must be a LPR or USC in order to act as a joint sponsor.

Most common RFEs are for these two things.

--IRS tax transcripts or tax return accompanied by W2 is fine for AOS. Three years is optional.

--Best to wait to get the email to pay the IV bill. Although I paid it before I received it and it was fine. Payment through in 12 hours.

--And I can still sign in. Come on Tuesday! :)

? Sachinky - what is the diff of Passport Office Police Cert for Beneficiary and Police Clearance Certificate? All we thought we needed was what he got yesterday, his police certificate. We are Jamaican embassy tho. Maybe things are diff?

I have totally confirmed my suspicion.... I am an idiot... I already see an RFE comming even before I send in my AOS package... I didnt properly fill out my I-130 nor G-325a.... where it asks for other names used I thought they were referring to last names... didnt even think to include first names on myself :( Dont know how to avoid an RFE with this one... all my legal documents <BC, Passport, Marrige Certificate etc> are in MELODIE and then all my tax information <SS card, pay check, bank account, IRS> are in MELODY....

I wonder, when they send me an RFE for this... what they might ask for? Would this be something that will just totally deny my husband's visa? I am kinda in panic mode :crying:

You are not an idiot! I dont think you will run into a problem actually. I think there would be more issues with different surnames, than just spellings of your first name. I would call the NVC and ask for a supervisor or a specialist (those operators are clueless most times) and see if they anticipate a problem. For your AOS package, I would just use the name used that is listed on your financial stuff (pay check, bank account, IRS, etc) that way all the docs for that package look the same. What first name did you put for your DS3032 (choice of agent)?

AND! Maybe if they DO ask for an RFE, an affidavit from you notarized explaining why your first name is spelled different would probably suffice.

Based on what country you are in, there are usually two Clearance Certificates you need to obtain.

My wife in India obtained a PASSPORT Clearance Certificate from the local Passport Issuing Office and the Police Clearance Certificate from the local Police Authorities. You can probably go to your passport office and find out if they have such a thing.

Or you could go to the NVC website ( www.travel.state.gov) and find out if applicants for your country do really need to produce both certificates.

My wife's name is also Melodie, and is says that on her passport and marriage cert etc, but says melody on her drivers licence i think.

I'm not sure about her tax / IRS stuff, but I totally know where you're coming from.

When I first met her, there were 3 different forms of ID that I got her name from

1. Melodie

2. Melodi

3. Melody

Craziness!

You are a gem! Thanks! It makes sense each country is a bit diff. For some reason, i was thinking the US has the same requirements for e.body. I read the reciprocity and just a police cert is needed for Jamaica. Thanks again.
