Actually, for your spouse's address, what are you using? Your address in Brazil or your FIL's address in US? Is your husband visiting you or residing with you? Maybe a call to a NVC operator could clear up this issue?

Thats what I was just thinking about now.

He is not using my address down here. All the documents will be the same address as his dad.

Maybe he should file the A then.

My husband was in a tourist visa but it expired this month and we had to apply for his residency. But it didn't go trough yet and he doesn't have any proof of domicile with me (no bank accounts, anything).

Does it matter if he is not a dependent of his dad (have own money, over 21yrs old etc) Or even that they "live" in the same house so it should be the same household?

Sorry it took too long my response... I was in the shower, and be heading to the gym in a few.

Hmm, if it's the same address as his dad, then yeah, I-864A, it is. I honestly haven't looked at the I864A since I didn't have to use it--so I'm not sure how the stuff is laid out. If they share the same residence, from my understanding it is the I864A, even if they're not claimed as tax dependents. I'd ask Christeen this question, she's super good with the AOS stuff. What I'm confused about is whether adding your FIL and MIL, presumably to his household size in order to have a contract with the household member, would that raise the amount limits or what your FIL's household size would be? My guess is 3 if your husband is not claimed as a tax dependent. But please corroborate with someone else, AOS is not my forte. :)

If you want to be really safe, you could send in BOTH maybe, see which one they need. They could discard the one they don't want. Be sure to send in proof that your FIL is really your husband's father such as a copy of his BC and that they share the same residence. Tax stuff or mail envelopes addressed to both of them at the same address. And proof that your FIL is a USC.

Ai aiii!!! I think it should be the A then. It hit me when I was in the shower thinking about it (yeah, think about NVC 24/7 hihi).

Immigration 'doesnt know' he is living down here since all the docts are in the US address.

He also has a sister, but she is in college, don't know if FIL claims her on his taxes or not. I'll give him a call and ask what he thinks. He is an accountant, should know better than me.

Who is Cristeen? The lady applying for her husband from UK?

Oh well.... let me go work out... gotta lose a few pounds before going back to the US. Lost control and ended up gaining a lot of weight there last year =/

Search for her on the forums. Her husband's from Italy. She's on the NVC boards sometimes so maybe she'll see this. Or send her a PM.

If your husband is using your FIL's address as his permanent residence then, my opinion is that it will be the I864A. I'm not sure what your husband would put for HIS household and what your FIL will put for his and how much the required amount will be. If he claims your SIL on his taxes, she's a +1 to the household size, nevermind the fact that she lives elsewhere. Talk to your FIL and husband and give the I864A a read. It is an easier document than the I864.

Also, how long is your husband going to live with you in Brazil? Remember that domicile has recently been an issue in several consulates. I'd check the regional forums.

Oh dear, Deb, I hope all of this is resolved soon and you can send in your AOS packet pronto. When did you order the IRS transcripts? They usually take about 2 weeks.

Is your DS230 packet ready? Send that in as soon as your IV bill shows as PAID in a day or two.

Tax transcripts for MIL were ordered on Tuesday only. My DS-230 is not ready, only medical to go. With all this hassle over the AOS there is no need for me to hurry it now so my medical is in 2 weeks. Could have had it on Monday but if I wait then it will be my monthly day off so I'll still be paid. I've given up on the April interview but he will be here in April still so it's not all bad! He just won't be here for the interview as we had hoped. I still consider us blessed because we've been able to see each other every 3 or so months unlike some .... :star:

Well, checked the NVC site and the IV bill was invoiced, so I paid it. (didnt receive the bill e-mail from the NVC, but looks like they accepted the e-mailed 3032) Just got my wife's police clearance from the Philippines yesterday and NBI today. We will get her korean police clearance next week along with her doing her advanced medical. Dang, I really wish I would have not forgotten the tax transcripts in my house!!!!!!! (although, I was going to send the AOS when I got back to the US as I dont trust the mail system from the PI)

Oh well, we will have all the stuff for the DS-230 package next week and I will just send it express mail when I get back to the US in March. So, if we are really lucky we might have an april interview. :D If not, May will be our month....just have to keep our fingers crossed with the medical.......NO SPUTNUM Test!!

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Well, I'm glad you're hanging in there. What does the DS230 have to do with the medical? I thought the medical was only after the interview date was assigned. Is this something for AUS only?

I paid my IV bill as soon as I received my DS3032 acceptance and it was generated. It cleared the next day and the email was also in the inbox by the time the payment cleared. So I think you'll be fine, Scott -- just have those packets ready!

Haha. No seriously, as far as I understand, the medical has to be submitted at the time of the interview to the consulate. For example, mine won't schedule the medical appointment unless I give them the interview date/time and interview letter. I'm almost certain it's the same for all CR-1s. Yes, people? The DS230 only has the police certificates, the forms, the marriage and birth certificates and the pictures. That's all.

And yes, I'm very loveable. :)

I pretty much have the DS-230 ready...just have to pick up the korean police clearance from the embassy in manila. I have my transcripts for 2008, 2007 & 2006, so i will be good for the AOS when i get back. I will file my taxes probably sometime in march and send copies of everything to my wife for the interview just in case they ask for 2009's. My 2009 return will be quite a headache, but i will be jumping on it when I get back as long as I have all the info to do it from all the financial institutions (didnt have everything I needed to file before I left for the PI)

Question on the Birth Certificate - is it true you can send a photocopy if the original will be presented at the interview?? I'm very paranoid. It took me literally 2 years and a trip back to South Africa to get this. It is precious and I would hate for it to go astray.

Which means I'm good to go??

I know in Manila we can do advanced medical even if we dont have an interview date (there are no appointments for the medical....just walk in). All we need is the NOA2 and something from the NVC with the case number on it.

Birth Certificates??? only one right...benificiary unless there are kids involved right?

Ok, I get the advanced medical but it doesn't have to be submitted to NVC right? It's just so that you can get a head start on the medical, RIGHT?
