A legal question....

So my best friend and her young daughter live in Canada, I of course live in the United States. She and her daughter's father have been discussing drawing up a will or other related legal documents to outline their wishes as to what they want to happen with their daughter if something should happen to both of them. They want to put Jerry and I down as legal guardians but in discussing this, we got stuck at one point.

I personally tend to think that if they have us named as legal guardians, we should be able to bring her here to the States and deal with paperwork (if any) afterwards. She worries that it wouldn't be as cut and dried as that and there would be a chance of her being sent to temporary foster care while the red tape was sorted out. Would we have to move back to Canada to make sure that didn't happen? Is there any paperwork we can have set in place beforehand?

I am not expecting anyone to have first hand knowledge of this topic, but maybe some guidance of where to look for information would be greatly appreciated!

Dont draw up a will without using an attorney. You draw it up wrong and the courts (probate) will throw it out.

Oh, and that is their plan, to do things legally, as they did when they drew up their custody agreement.
