Timeline

We applied for K1 visa and been approved already so we are waiting for the next steps..

I have been thinking lately about my daughters documents she might need. I am a single mom with a 4 year old and single. But unfortunately, his father acknowledge her and my daughter is using his family name right now. We broke up and out of contact anymore..

DO i still need a fathers consent for her to travel with me to US? Please need some ideas from people who have the same situation or those who might have any idea.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You might need to - most US embassies require it. (espeecially if the father is on the child's birth certificate)

You will need to contact the embassy you are going through to see what they require.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

oh my goodness! but thanks though for the info.. do you think i can ask the embassy ahead of time even i dont receive any packet from them?

Just read through the packet instructions for that embassy -

You will either need to show proof of custody for the child, or written consent from the other parent that allows the child to emigrate to the US with you.

In some case like this (I do not know PI/Thailand law) - you may be able to get a court order showing you cannot contact the father, granting you full custody.

Where is your daughter now? Is the father on the BC? Were you married to him?

My daughters here with me now in Thailand as I am currently working here.. and yes the father is on the BC but we were not married..

Use the links in my signature, print the relevant sections of Philippine Family Code and order your CENOMAR now. Since you never married the father you have sole custody under Philippine Law.

If you were interviewing at Manila the CO would know this already, since you are in Thailand I would suggest bringing the Law and CENOMAR with for the interview so you can demonstrate your sole custody. Also if you have a Solo Parent ID that would help.

You can order CENOMAR online and they/NSO will mail it to you. Get moving as it takes awhile.

I don't see the point of notarizing printing copies of the Philippine Family Code, the Embassy can easily verify it if they need to.

To get the Solo Parent ID you'd need to be in the Philippines and go to the Municipal Hall where you live. It's basically an ID that would provide your child with some education benefits since they have a Solo Parent. The reason I mentioned it is because in order to get it you need to prove that the bio-father has abandoned your child so the Solo Parent ID is actually proof that the Philippine Government accepts your proof the father is out of the picture.
