Ok so I am filing both at the same time and I am confused I read through some posts but they are all very confusing.

So correct me if I am wrong!

I need to make out two checks one for $1010(I-485/Biometrics) and the other for $355(I-130) for a combined total of $1365 right?

Btw. it would be awesome to have the fees in the guides.

Yes, this is correct. Made out to Department of Homeland Security. I've seen some people recommend making out a separate check for the biometrics fee-we didn't and we were fine.

No, this is not correct. Total is $1010 not $1365. For $1010, that includes cost of biometrics, EAD, AOS and AP. Just 1 check for all is all you need.

The original poster asked about I-130 (petition for alien relative) - not I-131 (AP). The OP says he is filing "both at the same time" - this is both I-485 and I-130. If the OP did not do a K visa, but is applying directly for a spouse who lives in the US, then the fees he states are correct,

The OP is asking about BOTH the I485 and I130. There are 2 separate fees for this. $1010 and $355.

Please read the questions thoroughly before trying to answer-if you don't know, don't answer.

trillium13 is correct, each service (in this case the I-485 and I-130) are seperate, so you would file seperate fee's for each service.

Paying immigration fee guidance.

Please Note

Personal checks must be pre-printed with the name of the bank and the account holder. Also, the account holder’s address and phone number must be pre-printed, typed or written in ink on the check. All checks must be typed or written in ink.

1.Write the date you are filling out the check including: day, month and year.

2.On the "Pay to the Order of" line write: "U.S. Department of Homeland Security." * note 1

3.Write in numbers the exact dollar amount of the fee for the service you are requesting. In the example, the amount is "$595.00."

4.Spell out the exact dollar amount of the fee for the service you are requesting. The "cents" portion of the amount should be written as a fraction over 100. In this example, the amount is "Five hundred ninety-five and 00/100."

5.Write a brief description of the purpose of your payment. In this example, it is "N-400 application fee."

6.Sign the check using your legal signature.

Note 1

Make the check or money order payable to U.S. Department of Homeland Security (not "USDHS" or "DHS"), unless:

1.You live in Guam and are filing your application there. In this case, make it payable to Treasurer, Guam.

2.You live in the U.S. Virgin Islands and are filing your petition or application there. In this case, make your payment to Commissioner of Finance of the Virgin Islands.

3.You live outside the United States, Guam, or the U.S. Virgin Islands, and are filing your application or petition where you live. In this case, contact the nearest Embassy or consulate of the U.S. Department of State for instructions on the method of payment.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

My friend is also confused about what to pay and since I came here on a K1 visa I'm afraid I'll tell her something incorrect.

She is going to file de I-130 petition concurrently with I-485, but she's got a 6 year old daughter and her questions are:

- Should she fill out a I-130 just for her and one just for her daughter? (total of 2 forms???)

- Will she have to pay $355/each (total of $710) or $355 total?

- And about the I-485 check: Should she pay $1,010 for her form + $600 for her daughter's? A check total of $1,610????

If anybody filed recently, which address did you send the packet to? (I found 2 different zip codes from USCIS website, if filling I-130 together with I-485)

I am not 100% positive but if she already has a K1 visa she does not need the I - 130 anymore. What type of visa the kid had? Why you guys do not also check with USCIS? They are pretty nice and helpful on the phone line. I used this forum a lot and it helped me a bunch but every time i doubled checked with USCIS. If i would get different answers I called again USCIS until I got at least 3 people telling me the same. Every time i wrote down the date, the name and the ID of the person I spoke with.

You have to keep in mind that on this forum most of the people are going/went thru this process by themselves after reading and researching a lot. Now, not everybody has a very good memory, or enough attention to read the questions or extremely careful answering them.

Thanks for the reply. I was the one that had the K1, years ago, and I did everything by myself also, like many people from this forum. I was pretty regular here.

I'm just trying to help a friend now. And since I'm already with my 10 year GC, I don't remember the things I did in the beginning, plus she is NOT in the same situation I was when I came here (on a K1). She is here with a tourist visa. So is her daughter.

She is here with her daughter on a B1/B2 visa, and I was just trying to help her by asking anybody here. I've already told her to call USCIS, but..... :wacko:

This is my best guess...

The I-485 filing fee is $1010 for the adult spouse of a US citizen, and $600 for a child under 14 (provided the I-485 petitions are submitted at the same time). The I-130 filing fee is $355 for each. So, the total is $2320.

Anyone else feel free to chime in and check my math, or tell me if I've forgotten anything.
