Husband will be sending the N-400 in mid-February. We've been married for three years at that point. However, we have tax transcripts for only 2007 and 2008, since we got married 2/14/07.

We could file our 2009 taxes just before sending the N-400 in mid-February, but I'm not particularly eager to do that since I know I owe a good amount of money from additional contractor work I did in 2009 (husband doesn't, but we file jointly). I was hoping to wait until April to send that check.... And, if we do file the 2009 taxes in early February before sending the N-400, that still won't leave time for the IRS to receive and send a transcript anyway.

So, should we just send W2s and an explanation for the lack of a 2009 tax transcript? I figure the interview will be in June at the earliest, so by then we could have the transcript for 2009 taxes we'll file in April.

Anyone in the same situation or have advice? Thanks so much!

2/27/10 Received biometrics appointment letter

3/19/10 Biometrics appointment

3/25/10 Received email notice that case will be sent for interview scheduling at local office

3/26/10 Received yellow letter asking to being more tax records/info to interview

3/27/10 Received interview letter (dated 3/24/10)

4/28/10 Interview appointment

6/5/10 Received oath letter (dated 6/1/10)

6/29/10 Oath ceremony date

Since the 2009 tax returns aren't required until April 15, if you have not filed them when you submit the application in February don't worry - send what you have and then be prepared to bring the final tax return or transcript with you to the interview. If, for some reason you get an RFE for the 2009 tax return, then you will obviously need to do them at that time and send a copy back to USCIS. Or, you could wait a few more months before you send off the N-400 until you do have 3 years of tax returns. You don't need to file immediately you become eligible.

Yep, but if you've ever tried to go out of the country on vacation with a West African spouse who constantly needs tourist visas (even as a U.S. perm. res., we found!), you'd want to get this over with ASAP. :)
