I-130 and Death Certificate

Timeline

I am a U.S. citizen filing a I-130 to bring my 2 step daughters to the U.S. ages 4 and 6. My husband was never married to their mother and she has passed. Will I need a death certificate for their mom, and if so what if we can not get one? I am just wondering when I file if they question where thier mother is, and if so we will need a death certificate and it will be very hard to get one.

I went to the USCIS in PA and asked questions, I was told to send as much paperwork as possible so we do not get any questions sent back becasue it could delay our I-130 for over a year. I want to get this question answered so we can file...

Please any help will be great.

Timeline

My understanding of the law is that the other parent would have to give consent. Given that the parent is deceased you would need to supply proof that the mother has passed away.
