Maybe someone knows the answer here, otherwise i call with the embassy.

My partner is a dual citizen from Belgium/ USA . He's currently living in Belgium since the summer. We want to marry each other in a couple months ( been together for 3 years ) . We live together here in Belgium and plan on getting married here.

Is the embassy going to make a problem that he lives here on his Belgium passport and married here? We think I can't get a immigrant visa because hes not getting married as an US citizen or they dont look at that? and see him as a US citizen married abroad.

If he is an USC - he's an USC in the eyes of the US government.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

It's not a problem, and he will be seen as a married USC as long as the wedding you do is legal in Belgium. The Belgian wedding certificate will be accepted if and when you decide to apply for a spousal visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

In the eyes of the USA, if the marriage is legal in Belgium, then it is legal in the USA... And if you are legally married and he is a USC, then he can petition for you... Since you both live in Belgium I would file for DCF (look at the guides here on VJ) once you are ready to move to the states. He will have to take steps to establish residency here in the USA...

4/4/2013. : Oath! Now a U.S. citizen!
