Timeline

Hi Folks,

I currently have a 2 year Green Card with restriction after coming in via the Fiancee Visa. How soon can I apply for the restriction to be removed. I have been told that it is a month before my 2 year wedding anniversary.

Was just wondering could I do it sooner, I'd like to do at after my wife and I file our tax returns this year, but was wondering is that too soon. Our 2 year wedding anniversary is in september.

It must be done in the 90 days period before the expiration date on the current GC NOT your wedding anniversary!. Doing it late = denied. Doing it early i'm sure they would also deny because it's not time yet.. but I don't know for sure but you wouldn't want to risk the "denial" because it was sent early meaning you missed the window to ACTUALLY apply. Just wait.

Doing it late is not automatic grounds for denial. You do have the chance to explain to USCIS why you are late filing, via a written statement when you file.

The reason have to be extraordinary circumstance beyond your control and the length of delay is reasonable.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
