Help Please - AOS Medical....

I and my fiancee filed a DCF (Direct Consular Filing) in Hong Kong, I am a Filipina and was an OFW in HK. When taking my medical, i did not get the oppurtunity to get my medical report.The HK Consulate mentioned that I may be able to get it from USCIS. Does anyone know where the packet of USCIS information I brought in with me and gave to US Immigration at the port of entry goes? My POE was Atlanta, Georgia. Has anyone heard of doing this? Any thoughts or advice anyone has accomplishing this task I would welcome the oppurtunity to hear your experience. Im asking about this because we are now in the process of filing my AOS and a copy of medical report would be important document to show the USCIS-Civil Surgeon. Yes, I know the medical is only valid for 1 year and mine is approaching soon. Thank you

It goes to USCIS. You will be unable to obtain a copy from them at this stage. You will need to contact the doctor that DID the medical in HK and ask them if they kept a copy and if they can forward a copy to you. I'm not sure why they said USCIS could possibly get you a copy, because if the doc doesn't give it to you SOMETIMES you can have the consulate photocopy it while you're having your interview (before going to the US)... you missed that boat though...

You don't get a copy of your medical report (at least I know k1's don't), you typically only get a copy of the vaccination record because it's needed for AOS, which is why you're told to keep a copy (or ask your doctor for a copy which was what I needed to do).

Sorry, those are really your only options outside of just getting another medical done but the reason for the vaccination record is without it, you would need to get ALL shots again :S I would call the HK doctor ASAP. Maybe they can scan and email you a copy (doesn't need to be original, copy is fine), or fax, or maybe you can have it mailed to someone in HK ('cause the doctors don't usually mail overseas) and then have them forward it to you.

DCF is only for married people, and it results in an immigrant CR-1 visa. You do not need to do AOS because you are issued a green card immediately upon arrival....

So, how far along in the process are you?

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

The OP states she and her 'fiance' have filed a DCF. This needs to be clarified. A fiance cannot file for a DCF - that is an option only available to a married couple. So, did you enter the US married or were you still engaged?

Since it sounds like your port of entry was Atlanta, and you are now doing the AOS that you did not do a DCF but a fiancee visa or, if married, a K-3 visa. The fiancee visa requires you to get married within 90 days and file for the AOS - Adjustment of Status. If you are not yet married, then you need to get married first before you file the AOS.

For the AOS you will need a copy of your vaccination history done by a Civil Surgeon in the US. If you don't have records of the vaccinations you have already received you have three options - obtaining the proof of the vaccinations from the doctor who did them back home or wherever they were done (you won't get them from USCIS at this stage of the game); having a blood titer test done that measures the levels of antibodies against each specific illness to show you don't need a vaccination, or redoing the vaccinations. The vaccinations can be done anywhere but you need to bring the proof with you to the Civil Surgeon so he can prepare the correct document. You do NOT need to redo the whole medical, even if the doctor tells you that you do.

Thank you so much for your time and advice. I already had my vaccination taken at Health Department just this month. And I got a copy of it. But i hesitate to go to Civil Surgeon knowing that the only proof i have with my medical in Hong Kong was a receipt and chext xray film, would this be enough proof to present to CS?. I really dont want to undergo medical again to avoid paying much.

I already send email to the doctor in Hong Kong...patiently waiting for their reply.

Hello Nik and Heather, I guess we misunderstood the DCF thing. I came here in the US thru K1 Visa. We got married within 90 days. At this time, still unable to submit my AOS because my I-693 form is not yet certified by Civil Surgeon.

I dont have a copy of my medical taken in Hong Kong in which it is still valid for 2 months more. Right now, i am still waiting for the doctor's reply so they can scan and email me my medical copy.

Ok, that makes more sense. You don't need a full new medical if you file within 12 months of your visa medical exam, and while it is worth a phone call to try to get a copy from the doctor who performed the exam, most people's experience is that they won't give it.

For the K1, you only need to have the CS complete the vaccination portion - sections 1, 2 (vaccinations only), and 5. The CS will only need to see proof of your vaccinations which should have been given to you on form DS3025.

There is a thread with civil surgeons who will do just that part, and if you get your filing off in a couple months, you're good.
