Hi all,

Filed in November, I just received my EAD card- like ten days back.

Happy as I was- I just noticed- that the day of my birth was misprinted: have a 3 in place of 5. everything else is fine.

I have a Green card AOS interview for 3rd feb.

I called USCIS 800# and the rep told me to file I 765 again and send the erroneous card attached to the Chicago lockbox. Ive been reading it is going to take a good 2 months before it is returned hopefully correct.

And then there is advice on just letting it be- they said the EAD card is taken away at the GC interview, so I shouldn't bother.

But Im worried that the date on my GC could be wrong too- and it takes both arms and both legs to have that screwup corrected.

What should I do- PLEASE advise... Can the interviewer ask me why I didnt send the EAD back to Chicago yet to have it corrected...??

Although I haven't had my interview or even filed AOS yet, this is my advice:

I think the person you spoke wasn't thinking about your case in particular with the GC interview coming up.

I would also think that when handing over the card if you point out the error, you can ask the person to put a note on the file about it, maybe ask them to double check the date on the greencard paperwork to make sure the messed up date is what it should be.

I would also think if you took the letter and envelope showing the date you had the EAD sent to you then they would understand why you waited a couple of weeks to correct it in person rather than messing with it when it gets handed in (usually, sometimes they forget) anyway. Fair enough if it was a really long time, but a couple of weeks is nothing.

Make sure you mention it and really emphasise it so they immediately fix it. Maybe even photocopy the card yourself and highlight the date on the photocopy and with an arrow point to it and then the other end write the correct date. Maybe then they can make sure that the photocopy (I'm sure they probably destroy the card and keep a copy) on the file is your copy making sure they don't stuff up. Just an idea anyway.

Thanks VanessaandTony- So its for a FACT- they do collect the EAD card during the interview right?

I will make mention that they check and see they have the right date on my green card...

I hope not because a green card is based on I485 and shouldnt have anything to do with EAD paperwork- I 765...

We had our AOS interview Jan 14th and they didn't collect my husband's EAD or AP. I'm not sure why. I would definitely bring it up at the interview though so they don't misprint it on the GC

As your green card interview is so soon, I would hold off on doing anything with the EAD at this time. They may or may not collect it from you at the interview. Definitely inform them at the interview that the date is wrong on the card and have them check your file to see that they don't have the date wrong there as well. If they have the date wrong, they can correct it then and you should get the green card issued with the correct information. If they have it correct, then it is just the error on the card. Regardless, they would not be able to process and produce a new EAD for you before your interview and after the interview and you are approved you no longer need the card.

I hope the officer is fine with me not sending the EAD already.

By the way the date misprint is on the emblem or something: both are inked black in the portion.

Only after I put the stupid thing under a strong bulb and tilted it, was I able to see that it was a three... :/

My husband recently had his AOS appointment on January 13th, at which time we were APPROVED :) but prior to that we had a similar problem with his EAD card, in our case, his last name was first and his first name last!!! We called the 800 # and were told we needed to refile, if it was their typo we wouldn't have to pay, but if it was ours we would have to pay the $340.00 - so we started to complete the new form, and recieved a letter in teh mailed that our I130 & AOS were DENIED due to a no show (we had asked for reschedule) so we scheduled an InfoPass appt - at which time they REOPENED our case - and then also advised us to send in the form for the name change... so we DID (along w/ $340.00) :bonk:

Now it brings us to our interview on Jan 13th, we were told by the agent who was conducting our interview, that we should have never sent the form in and that his GC replaces the EAD card - and that the agent back @ the InfoPass told us the wrong informaiton about re-filing the EAD..

So my advice is along as you don't have to get your license renewed (the problem my husband is having) or you are starting a new job - WAIT for you AOS appt. I wouldn't want to see another VJ friend out of money like we are in this case...
