My husband's (then fiance) POE was at JFK he was given a work authorization. I am confused if he can work or not. :help: If he can work does this work authorization have some sort of restriction on time limit or not? Do we have to fill out EAD card form as well?

There was a time, not too long ago, when green cards took 6 months to two years to show up. You would apply for an EAD, which would take 2-3 months to show up, and it would allow you to work until the green card showed up. Nowadays, the green card takes 2-4 months, so the EAD is not as necessary as it used to be, but the process remains the same.

You apply for an EAD at the same time as you apply for the green card. You do not have to pay anything extra for the EAD: it is included in the cost of your green card application.

The rules about working have changed in the last year. It used to be possible for K1 visa holders to get an EAD stamp that would allow them to work for the first 90 days they were in the US. This was still inadequate, since there would always be a gap between the end of that 90 day period and the arrival of an EAD card, ordered with the AOS, that would be good until your green card arrived. You would not be able to work during that gap, and would have to either quit your job or take a leave of absence until you again had a valid EAD card in your hand.

As I said, the rules have changed. The stamp (which is now only available at JFK airport) is no longer valid work authorization, and it is now impossible for K1 visa holders to work at all unless they have an EAD card in their hand.

Things are slightly confusing, because it is also technically possible to apply for an EAD immediately upon entry. Nobody does this, for the following reasons:

A ) This EAD would expire 90 days after you entered the US, and there would still be the gap between it's expiry and when you received the EAD from adjustment of status, during which you could not work.

B ) This EAD would cost you approximately 300 dollars. The EAD you apply for when you apply for adjustment of status is free, included in the price of your green card application.

C ) You cannot work without an EAD card in your hand. This EAD, which would expire in 90 days, is unlikely to even arrive before it expires, rendering it completely useless.

As has been mentioned above: in order to work you need one of two combinations of documents:

A ) a valid EAD card and a social security card

or B ) a valid green card and a social security card.

Regarding your medical form, I had the exact same thing you do. I took it to a local civil surgeon (you can find them listed on the USCIS web site) and paid them a nominal fee (approximately 30 dollars US) to transcribe it onto a form I-693, which they seal in an envelope You include the sealed envelope with your AOS application packet.

Some people, several months ago, reported success just sending that piece of paper, but more recent reports have indicated that the vaccination worksheet (what you have) is no longer being accepted and that you need to have it transcribed to an I-693 by a civil surgeon. Do not let the CS convince you you need to redo your medical examination. They should simply transfer the information to the new form, and seal it for you, per the instructions on the I-693 form, which is available on the USCIS website.

It's okay that you couldn't change your name just yet. As long as your marriage licence has your name change on it, when you apply for AOS put your married name on the forms so your cards (EAD, AP and GC) have your married name on them. Changing your name AFTER AOS will cost you about $300 to get new cards with your new name. Your marriage licence acts as your name change document as well as proof of marriage for AOS purposes.

There is only ONE biometrics appointment as the biometrics you take for the EAD are used for the GC

As the EAD and AP (advanced parole.. used if you need to go home while AOS is pending) is free with AOS most people just fill those in too. It's not a lot of extra work and it's better to have than not have. Some peoples greencards have taken MONTHS to come, and at least if you have your EAD you can get a job if it does take this long. The AP should only be used if you have NOT exceeded your I-94 date by 180 days or more.

One reason people don't bother with EAD is because they get their GC so soon afterwards. This isn't in ALL cases though and like I said above, it's better to have than not have, just in case.

You are NOT permitted to work on a K1 unless you have an EAD. You will need the SSN as your "id number" so those two will be used together. Once you get your GC the EAD is useless. They typically take it at the GC interview so if you have a job you can ask for a stamp (though I've been reading that this is being done less and less).

If the medical form you're talking about is DS-3025 (here's an example: http://www.visa-talk.com/DOC/Medical-forms/DS3025.pdf you'll see in the bottom left corner it says DS-3025) this is the vaccination form that you need to send with AOS. Although the instructions say that if your shots were completed that's the only form needed, a lot of people have had RFE's asking for the form I-693 vaccination part to be completed. This doesn't mean you need a new medical, it means you simply need to take your vaccination form to the CS (picked from this list here: https://egov.uscis.gov/crisgwi/go?action=of...ffice_type=CIV) and have them check it, transcribe it into the I-693 for you, and tell you if you need any more shots (since I had my medical in July 09, the requirements have already changed so I MIGHT need new shots) and then they seal it in an envelope and you send that with your AOS.
