Aight so i went to get my ssn card today and i should receive it in 1 to 2 weeks

i couldn't adjust my name since the wedding document are back log as well for a minimum of 8 to 10 week!!

so i kept looking at the list today and now i see there is the I-765 (optional)

for getting a EAD

i thought the ssn was exactly to work

anyway if i don't file for it i can't work until i get the green card right?

i thought my visa was enough to work till it expire at least

so it give me 3 months? then what when does this EAD can be used

Also another question

Do i need to go to a civil surgeon if i have that paper from medisys ?

Hi Ebrech N Persona,

The SSN and EAD are two different things...

The American SSN is basically like a Canadian SIN, a number that identifies you and is needed for work/financial purposes.

You will need an SSN in order to work here in the USA, and for other purposes too, as you will soon find out

(lol..you better have that SSN number memorized...it is used so frequently around here...)

The EAD is like a temporary green card for work purposes, that you use while you are waiting for your green card.

Basically the EAD is an employment authorization document, which shows that you have "legal status to work in the USA" while your AOS case is pending

Before you get your green card, you have to show both your SSN and your EAD in order to work.

After you get your green card, you have to show both your SSN and your Green Card and in order to work. (and your EAD becomes "useless" after this)

So, depending on your priorities...and if you need to work right away...you can choose to get your EAD, or not at all.

For me, I chose not to get my EAD or AP...As I had no need to work in the USA right away or go back to Canada while my case was pending...

So I just waited for my green card....which took 3-4 months or so, which was the same timeline as the ead, which makes the ead pointless!

(see my VJ timeline for more info...)

Lol..In fact, some VJers have even said that they got the EAD after their Green Card...Which doesn't make sense at all...And is a waste, indeed.

Needless to say, by not applying for the EAD or AP, I saved $300+ or so! Better off to use that money somewhere else..lol....(for future immigration cases, I suppose...lol....)

So yeah...it boils down to:

Do I want to work right away before I get my Green Card? (apply for an EAD if this is the case)

OR

Can I wait until I get my Green Card in order to work? (don't apply for the EAD in the case, and just wait for the green card, instead...)

Hope this helps too. Good luck with the rest of your journey.

You came on a K-1 visa, that doesn't give you work authorization. You can file AOS and your EAD together..which are the next steps. Your visa will be mute as soon as you marry. You do have 90 days to do so...but that does not give you the ability to work.

"...My hair's mostly wind,

My eyes filled with grit

My skin's white then brown

My lips chapped and split

I've lain on the prairie and heard grasses sigh

I've stared at the vast open bowl of the sky

I've seen all the castles and faces in clouds

My home is the prairie and for that I am proud…

If You're not from the Prairie, you can't know my soul

You don't know our blizzards; you've not fought our cold

You can't know my mind, nor ever my heart

Unless deep within you there's somehow a part…

A part of these things that I've said that I know,

The wind, sky and earth, the storms and the snow.

Best say that you have - and then we'll be one,

For we will have shared that same blazing sun." - David Bouchard

You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. Yes...It applies to you...So if you file the I-765...It's free for you I suppose, since it is included in the AOS fees...:)

Lol..As you can see, I filed way before 2007 (in 2006)....and back then it was a separate fee....(lol.and a lot cheaper too...it was only $170 back then)

So I could save EAD and AP money ($300+ total) back then by not applying for such....lol....

But this 'discount' does not apply to you...lol......Never mind what I said earlier about saving money for you.....

Times certainly have changed, indeed!

But since the EAD is included for you at no extra cost because it is part of your AOS package anyways..

So it boils down to...Do you want to work now (EAD yes)? Or do you want to work later? (EAD no).....

Also more of a "piece of mind" thing before getting your Green Card....as to if you want the extra EAD card or not...

And with the EAD it is more paperwork and another biometrics appointment too.......

Lol...and don't be surprised if your EAD comes after your Green Card.....

You might want to check out timelines for the EAD and for the Green Card, here on VJ....See what is quicker there too....

So whatever you decide, good luck there....

Hope this helps too.

well as you say

GC take 4 months and EAD take 3 months

about the biometric part i don't see where it is required

so to make sure i won't do it

for the other question now is that piece of paper from medisys good ?

i still need to fill my 4 copies of G-325 and then i just put the paper with it ?

The EAD might take shorter and the GC might take longer.

Last I checked, the EAD was about 2 months after AOS application -- approval is around 2 weeks after your biometrics. GC varies -- those that are processed in the local Baltimore office wait 4-5 months, while other applicants in other states just wait 2 months.

I would say since the EAD form is soo simple, and its part of the application, and you need a biometrics appointment anyway to apply for a GC, just apply for the EAD with your AOS.

When you get a job, you have to fill out the I-9 form(google it to see what it is), so you must give them any 1 or 2 items from their list depending.

The K1 and SSN is not an option. Your SSN will say "Only Valid with DHS Authorization" and your authorization is your EAD card.

Once you get a Greencard you no longer have to show your SS card. Just the Greencard!

Yeah but what do you mean about medsy paper being good? If you mean, do you still have to see a CS to get your vaccines transcribed, the answer is yes. There were some AOS'ers that got away without doing the transcription again, and just included their sheet of paper with the vaccines in it, but lately lots of people have been getting RFE'd because of the medical.

My suggestion would be to go do a transcription and include that and the medsy paper for your AOS.

The paper from Medsys, if anything, proves the date of your foreign medical, so you don't have to have another full medical when you get the I-693 transcribed. Either way, the vaccination portion of the I-693 will need to be transcribed by a civil surgeon in the U.S.

If you wish to chance it and simply send in your DS-3025 (the paper from the Montreal medical), you can... but you will most likely be given an RFE, which just adds to your time of approval for you AP, EAD and AOS.

It's okay that you couldn't change your name just yet. As long as your marriage licence has your name change on it, when you apply for AOS put your married name on the forms so your cards (EAD, AP and GC) have your married name on them. Changing your name AFTER AOS will cost you about $300 to get new cards with your new name. Your marriage licence acts as your name change document as well as proof of marriage for AOS purposes.

There is only ONE biometrics appointment as the biometrics you take for the EAD are used for the GC

As the EAD and AP (advanced parole.. used if you need to go home while AOS is pending) is free with AOS most people just fill those in too. It's not a lot of extra work and it's better to have than not have. Some peoples greencards have taken MONTHS to come, and at least if you have your EAD you can get a job if it does take this long. The AP should only be used if you have NOT exceeded your I-94 date by 180 days or more.

One reason people don't bother with EAD is because they get their GC so soon afterwards. This isn't in ALL cases though and like I said above, it's better to have than not have, just in case.

You are NOT permitted to work on a K1 unless you have an EAD. You will need the SSN as your "id number" so those two will be used together. Once you get your GC the EAD is useless. They typically take it at the GC interview so if you have a job you can ask for a stamp (though I've been reading that this is being done less and less).

If the medical form you're talking about is DS-3025 (here's an example: http://www.visa-talk.com/DOC/Medical-forms/DS3025.pdf you'll see in the bottom left corner it says DS-3025) this is the vaccination form that you need to send with AOS. Although the instructions say that if your shots were completed that's the only form needed, a lot of people have had RFE's asking for the form I-693 vaccination part to be completed. This doesn't mean you need a new medical, it means you simply need to take your vaccination form to the CS (picked from this list here: https://egov.uscis.gov/crisgwi/go?action=of...ffice_type=CIV) and have them check it, transcribe it into the I-693 for you, and tell you if you need any more shots (since I had my medical in July 09, the requirements have already changed so I MIGHT need new shots) and then they seal it in an envelope and you send that with your AOS.

I hope that answers your questions :D
