N-400 and I-751 TOGETHER?

Hello everyone!

It has been a while since I logged into VJ. I hope everybody are doing fine with all your process and getting good news on Green Cards and K-1's, K-3's, etc.

I have a big question that I hope somebody can help me with... I want to join in the army because has been my dream since I was a teenager and I have the chance to do it now, but unfortunately the career I want to persuit requires a security clearance that, of course I'm not eligible to get.

Talking to the lawer from the Fort where my husban is stationed, mentioned that because I'm married to a military person, I'm eligible to apply for the citizenship having 3 years of marriage and I can mail my N-400 within 90 days before my third aniversary, but then the problem:

Because the expiration date of my provisional GC, I have to mail my I-751 on August 2010 and following what the lawer told me I have to mail the N-400 on October 2010... my question is: Is this possible?? Can I have 2 process at the same time?? It is good or bad for the citizenship having the I-751 on process? Should I wait until get the I-751 approved and then apply for the N-400?

You can apply for naturalization 90 days before the 3rd anniversary of becoming an LPR, not your wedding anniversary.

Which month will you be eligible to file N-400? Remember you are eligible to file 90 days before it has been 3 years since you recieved your GC not your marriage.

If that month is on or before Aug 10, just file N-400 and do not waste your money on I-751 and if not, my friend you have waiting so long a few more months wont matter, go ahead and file I-751 wait till it gets processed and you get u r 10 yr GC. I am sure by then you will be eligible for filing N 400

BAD advice! If the OP has a conditional green card it is mandatory that he apply to remove the conditions on that green card 90 days before that green card expires. The conditional green card is valid for 2 years. He is not eligible for citizenship until 90 days prior to the 3rd anniversary of the green card. If he doesn't file to remove conditions on the green card he will never reach a third anniversary of the green card because once it expires he is out of status. He needs to file the I-751 during the 90 days before the green card expires. He will receive an NOA letter that extends the validity of his green card for 1 year. If there still has not been a decision on the Removal of Conditions by the time the 90 day window before the third anniversary of the green card date opens, the OP can THEN file the N-400 application. It will 'force' a decision on the I-751 because that needs to be decided before the N-400 can be processed.

I apologize and I see the flaw in my response. I was too dumb to realize that the conditioncal GC is only 2 years but yet i go on saying that you are elgible and should apply 90 days after 3 years of you having a GC.
