Timeline

Hi i have 3 questions.

when someone go to the interview for N-400, and the interviewer ask for his Green card and his passport. and when the interviewer look at the Visa on the passport and see it expired while he was filing for his green card is this can be a problem for the N-400 (Citizenship) ??? on other word. if somebody came on K-3 Visa, (good for 2 years) and then he dint file for his green card during this 2 years and his visa expired, but he filed after the visa expired for his Green card and he got his green card with no problem ! now when he file for his citizenship can it be a problem !!! because someone told me ... they asked him why he dint apply for his green card while the visa was good. and then he got Denied. on his Citizenship because of this too, is this true or he's dreaming?

During the Interview for the Citizenship is it possible for the interviewer to ask the Applicant a very very personal questions?? because someone told me he got asked very very personal questions. Like.. when did u have SEX with ur wife ?? .. can this be possible or Imposible???

about the tax return.. we know tax return has to much papers. do i have to send them all when i apply for my citizenship or there is a certain papers i can send instead to send all the papers??

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

I'm not sure about the other two questions, but the Officer may want to see proof that you are "honoring" your wife: pics, videos, etc. Just have some ready for him to watch.

Just kidding, but if you've seen the movie Green Card with Andie McDowell and Gerard Depardieu, then you know it's possible to have a nosy immigration officer that asks you such questions. It shouldn't be a problem to remember, unless you have kids :)

It depends upon how you got here with your passport and visa, had to be valid during the AOS stage and before your I-94 expired, after you received your NOA, you are legal to stay, but might take a year to get your green card. That is why they can cream you with the extra expense for an EAD and travel document. Really no law that you have to keep your foreign passport current, and if you didn't make any trips during your LPR stage an invalid passport would be proof of that.

Hearing stories during the AOS lead me to hire a major US immigration law firm, while we attended the AOS interview alone without the attorney present, could have been with their name on all the forms, they didn't want to question us. That is so typical of our court systems, see judges shake on the bench when a big powerful law firm is present. They told us to handle the I-751 and N-400 by ourselves, I feel they didn't want me to pester them due to the excessive delays in these applications.

As far as the USCIS was concerned, our marriage was defined by sharing our financial life together. Did not on our marriage certificate, did say it was not valid until we consummated that marriage. LOL, had to look that up to see what they were talking about, but apparently they took our word for it as no judge was present.

They wanted to see our original tax returns, in that case, wife's IO was nosy in that she looked at every page including the 1099's and W-2's. I see no reason for that, would seem our joint IRS label would be enough. IO dependent I guess whether they are interested in your financial standing or your love life. Our love life was never mentioned. But we are paying taxes together, isn't that sweet?

I would think if there was a problem with your residency it would have come up long before this. Even if you are out of status you are allowed to adjust status to become a permanent resident if you entered the country legally which you did. The out of status time is forgiven when the green card is approved. If they had problems with you being out of status they would not have approved your green card. If you meet all of the requirements - physical presence, residency requirements, still married to the same US citizen who sponsored you to the US, no criminal record, etc. there shouldn't be a problem with granting you citizenship because you were out of status before you got your green card.

Well, they can ask you anything if they want, although very very personal questions like this are much more likely at the AOS or the Removal of Conditions phase of the immigration process. You are required to submit documentary evidence that shows you are still married to the same US citizen. I guess, if they suspect your marriage isn't valid they may ask you a question like that, but I would suspect they would not ask such a question unless they had suspicions about the validity of the marriage. I know that they asked no personal questions other than the ones asked on the N-400 document or that were related to the submitted evidence at my interview. It was the easiest part of the whole process - very professional and polite.

Yes, it is much easier to send the official tax transcripts from the IRS. They are free of charge and you can order them either in writing or over the phone. By doing it over the phone you use the phone touch pad to type in the years of tax returns you want. They can either fax them to you so you get them quickly or send them to you in the mail. They are much easier to handle than having to submit all of the attachments and other documents that go along with the tax return. No it isn't - they can ask if the marriage is consummated - they will not ask for specifics though...

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
