SSN Issue, Help please!

Timeline

I had J-1 Visa when I met Matt so I got a SSN with that type of visa and my old last name, Now I have my k-1 I got to the US, got married and I want to change my last name with the SS people before I send the AOS. (Can I fill the documents for the AOS with my husband's last name before I change it with the Social security people? or should I just fill it with my ?old last name?) I don't know what to do...

If someone has a SSN recieved with a J-1 Visa please send me a message please please

Yes, you can send in the AOS with your married name before changing it with SSA. If you wanted you could change it with SSA and file the AOS in your maiden name. The two are not related.

I have a similar problem, except that I already filed and I want to change my name now. Are you saying that I could do that with SSA without causing a problem with my green card applications, etc?

If you filed your AOS with your maiden name or married, but hadn't changed it with SSA and now want to change it with SSA, it's not going to affect the processing of the AOS. Immigration does not check with SSA when processing the AOS.

The problem can be if you don't file the AOS with your married name and also don't change it with SSA and want to change it after the AOS has been processed, At that point your immigration document, which SSA considers your legal name and would be your identity document has your maiden name.

C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and DHS issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, presume the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

In cases where an alien applies for a replacement SSN card and submits an immigration document showing a name that is different from the name on the prior Numident record, accept the immigration document as evidence of the legal name. In these cases, the prior SSN card may have been issued in a name that was not the NH’s legal name.
