Hi all,

My name is Nathan, I recently engaged with my fiancee in Viet Nam. I want to start a K1 paperwork, but i never think that i will do the paperwork in 2010, so my 2009 tax is $12,500 after tax. I know that i dont qualify for sponsoring my fiancee. My questions are:

1) How much money in the bank that i will need to have in order to make my case strong? Or what kind of assets will help me?

2) If i have a joint sponsor to help me, and he made $32,000 this year before tax, and he is single. Will that be enough to help me? I read that he have to make 125% above the poverty guidelines. what does that mean exactly?

Any answer will be greatly appreciated.

Hi Nathan - My Name is Darnell - I can't possibly imagine the type of conundrum that you've espoused in your post here.

If money is important to you, get that 55K / year job NOW, then file the K-1 the week after you have the employment letter. Current Work with higher annual salary trumps prior years.

I've read here on VJ that a co-sponser for a K-1 in HCMC is useless.

For Dollar Assets, I suggest 55,000 usd in a savings account, but that's just an arbitrary number.

HCMC will not allow a cosponsor 99% of the time..don't count on a cosponsor. you will need assets valued at 3 times the amount you are short on your income... will your income be low in 2010 also? was it low prior to 2009? HCMC is a difficult consulate to get approved through so I recommend that you do alot of reading in the vietnam regional discussion... frontloading the petition is advised by many when it comes to HCMC...

money in the bank, stocks, a home, cash value of insurance.... they look at real assets...

Darnell: You are right, i cant even understand what i wrote before. For that, i am sorry for the confusing. Thanks for your advice.

Scott: Thanks for the head up, i will do more reading on the vietnam regional discussion. My income will be higher in 2010 for sure cause now i know more. I didnt think i will do any paperwork this year, thats why i set my income so low in 2009. Will i better off just wait for next year before i can do the paperwork? Please let me know.
