I-864 item#25 - Federal Income Tax Return information

Hi, I'm preparing for my mother's application (IR5). I'm now filling out I-864.

I understand as long as my AGI (adjusted gross income) is more than 2009 Federal Poverty Guidlines - $18,212, my husband does not need to fill out I-864A.

I-864 Item#25 - "Federal Income Tax Return information" is asking for the most recent 3 years of my income. I will submit our tax return transcript as support document. My husband and I filed jointly.

My question is if I should input the amount of ONLY my yearly AGI (adjusted gross income) on item#25 even we filed jointly? My concern is the transcript only shows our total AGI. It does not show how much my individual AGI is. How can they know the number I input on the form reflects my income?

You will list your income on Q 23, Q24 a and on Q25 you will list your income for the last 3 years and then you will submit IRS Federal Tax Transcripts and the transcripts lists both your income and also your spouse's income too along with SSN and other details.

We file jointly too and i was the petitioner for my parents and i filed as said above.

Raj, my husband and I also filed jointly so on the tax transcripts, it doesn't show how much my income is because it's showing the combined income. Do I just put the amount that is written on my W-2?

Yes you can put the value from your W2.

Use the income on your W2. Make sure you attach a copy of it so they can verify it. Write a note explaining that since you qualify on your own, your husband won't be filling out a I864A.

I have a question about this poverty guideline. If my income myself is below $18,212 what will i do? DO I need a sponsor?

You need another member of your household to co-sponsor (e.g., your husband, sister, brother, etc.) and fill out form I-864A.

Get a joint sponsor. If she/he lives in the same house as the petitioner, then they will fill in a I864A.

If she/he lives in another place of residence, then they will fill in a I864.

The primary sponsor fills in a I864, regardless of income.

Don't forget to add proof of citizenship/residency for the joint sponsor.

We filed jointly and we made 42 thousand a year, are those numbers enough for the poverty guideline to petition my parents?
