USC petitioner joined uneligible kids on the petition..!!

hi to all.,

I am here again to ask for some steps to make,forms and requirements needed for my kids to bring in US..

i hve 2 kids which is not eligible son and daughter of my (USC fiance),but he included my kids to the petition he filled up (K-1)to be follow after we get married because we both wanted to join my 2 kids as he treated them as his own too,in our journey of embracing future as one family at his country..they are both filipino kids of mine from my ex live in filipino partner before..my son's using his filipino father's surname..but my daughter using was at mine..what visa type we will apply for them.?.. and what process makes them easy to get visa without any trouble as uneligible kids of the petitioner..? we need a helpfull informations.,suggestions from all of you here kindly VJ members..we realy dont know yet what to do now..

Why do you say they are uneligible?

If they are your biological kids, but not your US fiance's, you should be able to apply for K2s for them if they will come with you at the same time or within a year of you getting your visa. If you didn't apply for them in your own K1 paperwork, once you are married your USC husband can apply for them with the usual I-130 as their step father, assuming they are minors.

you can apply for K2 visas for them (they are what are called derivative of you, a K1 visa holder) and will undergo a process essentially similar to yours (medical, interview)

there really is no trouble for your daughter since she's using your maiden name, but for your son you have to prove through documents that the father and you where not married (since you said you just lived in together) and/or that he's ok that you will be taking your son to the US.

And thats the problem now ..where i will find my ex live-in partner.. i dont have any info. where he is right now..since we gt seperated..i never see him anymore,no contacts even supporting my kids..do we need to talk for an attorney regarding with this case..bringing my son to the US to live with me there instead of getting approval of my ex live in partner..? OMG., dont know what to do really..

If you cannot locate your ex, you may be able to get a court document allowing you to take the child abroad, especially if you can prove the ex hasn't had any contact or supported the child for several years.

BTW, they are not your fiance's illegitimate kids... that would mean his kids, born out of wedlock, but they are not biologically his, even if he wishes to treat them as his. Your kids are your fiance's future step-children.

The question in here is that DID YOU AND YOUR EX GOT MARRIED?? WHEN YOU WERE STILL LIVING TOGETHER??...if NOT...then you dont have problems getting a k2 visa for your kids............

Yes me and my ex ddn't got married when we living together before..also stated that at my son's birth certificate..i did got my CENOMAR ( certificate of no marriage) i am still single there..and thats the good thing..!! hOOray.. at NSO ( national statistic office )!!.i do search some info. too with this case of mine.,about adopting my kids too of my USC fiance..is it ok now i ready all the requirements and documents they will needing on getting K2 visa..?

Someone has to correct me on this if I'm wrong, but what I know is K2 is the derivative of K1 so you must file the K2 at the same time you were filing your K1. Based on your time line you are almost done with your medical so the next step is your interview. I suggest do the I-130 after you get married to your USC fiance and he will be the one to petition your kids as his stepchildren.

Not exactly. A K2 application can be filed at the same time as a K1, if the child is going to go to the US at the same time as the K1 parent. It can also be filed up to a year after the K1 is issued if the child is going to join the K1 parent in the US, called "follow to join".

thats a bit different.

'illegitimate kids of usc citizen', would mean that the usc is the biological father, and the mother (perhaps you) is not married to him, was never married to him.

The K-2 FTJ can be set up with documents to the Embassy, prior to interview day -

if the USC failed to file the PROPER documents on initial petition submittal.

Follow the link in my signature, that post contains the relevant Philippine Family Code that states if you were never married to their father then you are the unwed mother have sole custody of the kids.

The USEM in Manila should be well versed in Philippine Family Code for this but I would suggest printing the Family Code and having it at the kids' interview as supporting documents along with your CENOMAR, proving no past marriages, to demonstrate there is no need for the bio-father's permission.

Check out the Philippine sub-forum, this isn't uncommon in the Philippines.
