HI Visa-Journey

I want to know that can i remove condition after divorce? in my case. I married to my second husband after my first husband's death it has been 3 years after my second marriage and like 10 months here in U.S.A with my two kids from my first husband. I am on cr1 visa. i don't know my kids visa but they were not adopted by my husband. Now he wants divorce we live in Illinois which is no-fault divorce state which I guess is that if he wants divorce he can get without any reason right? He and his mother always mentally torture us and he always get angry at small things. my first son is 15 years old and my second son is 6 years old. I don't have any relative from my side. He doesn't have job and i think he don't want to do any work. I have a job and i am also paying TAX which can be shown as "good faith" evidence am i right? he has shown me the divorce paper but i am refusing to sign. i want to live because i like it here now and my Kids also wants to live here but my husbands want us to leave and i and my kids have 2 years GreenCard. i have to go court in 2 days and I don't no anything about here? please help me how to remove the condition.

I would appreciate any information.

to my understanding if you can show effidence that you enterd the marriage in good faith

and you have the divorce degrea you are able to file roc with a waver by your self

your husband cant make you leave , you have a GC only the Gov would be able to make you leave

Talk to a divorce lawyer - depending on the state, rules vary on divorce.

You can file for a waiver to not file "jointly" - then you can attempt to remove conditions yourself. (read the I-751 instructions closely).

Most of the time, you file for this after you divorce, however, you can file prior, and delay the removal, since your reason is waiting for the divorce.

However, you mention abuse - so you could go that route.

(immigration lawyer may be helpful)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Chetna, hi, how was your appointment in court ? I hope good. At least you have a work, it's a blessing. I got my divorce recently. It took 3.5 months. My exhusband did not let me work or driving, etc. But I was a retirement person in my country, thanks God. He made me many spcychologycal abuses difficult to prove, I lost 6 kls. of my weigh, besides he cut food, cell, computer, tv, heat...and he went to my country and tried to get 50% on my things. If he does, he must return me here what he takes. I have to get a lawyer. Good ! I am a survivor ! I have lots of evidence that my marriage was in a good faith, anyway, my GC expires in 2011. Now I am learning to drive, looking for a job to present my Remove of Conditions sooner.

Fortunatelly I am a "strong" woman. I never thought after a year I would be divorced. Life is so!

Check with a divorce lawyer, but I believe that even though Illinois rcognizes no fault grounds, you still have to be separated for 2 years before a judgment of divorce can be granted.
