Son's file seperated from the rest of the Family for I485

Hi, my husband, myself and our 2 sons applied last year April for our Green Cards. We have gone back and forth with more information needed, etc. It seems our older son who is 16 has been separated from the rest of the family.

When we all had our Biometrics appointments, he had not gotten his appointment notice yet; but we took him anyway and the USCIS office here in Florida did it for him.

Because the whole process takes so long we applied for work permits along with our I485 forms. My husband and myself received our work visa's November 2009. Nothing on my so's work visa.

We had our interviews with USCIS on December 24th; we took our son with us hoping that the immigration officer would be able to interview him too. The immigration officer was very nice and helpful, but when he did a computer search for our son's file it was in Missouri and therefore he could not be interviewed.

Yesterday, my husband, myself and our younger son got our Green Cards!!!! YAH!!!!!!!!!!!!!! However sill NOTHING about our older son.

About 3 weeks ago I decided to call USCIS to tell them the problem I had; that our son's file had been separated from the rest of the family. That proved to be NO help at all as the customer service rep told me exactly the same information I already knew from his case number which shows up on their web site. She actually read it to me word for word like I was stupid. She realized my frustration and put me onto an immigration officer who again was NO HELP and told me what I knew already.

I was told that since my son's case was separated, that the officer who was assigned to his file had requested more evidence. We had produced this evidence and got a notice saying that they HAD received it. This is exactly what his case number says.........

On November 25, 2009, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location.

The immigration officer told me NOTHING can be done until it has been over 90 days, which will make it the 25th February. This is so frustrating as we have all received ours and we do not know what is going on with our son.

Has anyone had anything like this happen to them? Have a family member been separated and the rest of the family's papers been filed? Is there anything I can do? Do I have to wait the 90 days, and then what?

This is so upsetting as we want to celebrate our Green cards arrival but hate that our son;'s own is out there still. Any advice would be greatly appreciated. Thank you, Lisa

write to your local elected official explaining the situation and ask them to look into it. The same thing happened to my friends and she received the card approximately 3 weeks after sending a letter to the local assemblyman.
