Hi all, I searched this forum but couldn't find the answer.

Basically, my fiance ( F1 Visa holder ) and I ( US Citizen) are getting married next week. We will also apply for her AOS once we get our marriage certificate. She will change her last name in the marriage certificate and in all submitted AOS forms.

My question is does she have to change her last name in her passport, F1 visa, driver license, and social security card while the AOS case is pending? We want to open various joint accounts but I'm afraid we'll run into conflicts. Should we wait until the AOS is approved before we open these accounts?

Also I was talking to an immigration lawyer and he's charging about $1200 to help me with the AOS process. Do you think I should hire a lawyer? It seems like you can find most of the AOS related answers in this forum.

No. It's not needed but when and if she gets her GC, it will be in her married name and not having the other stuff the same would be weird. The f1 visa I think isn't needed after the greencard so that doesn't matter, passport I wouldn't change until AFTER this is all done.

We want to open various joint accounts but I'm afraid we'll run into conflicts. Should we wait until the AOS is approved before we open these accounts? No. You have her marriage licence which is the name change document. She can open accounts with a SSN (think this should be in married name), passport and marriage licence.

Also I was talking to an immigration lawyer and he's charging about $1200 to help me with the AOS process. Do you think I should hire a lawyer? It seems like you can find most of the AOS related answers in this forum. If your case is simple there's no need. What did the solicitor say? Did they mention anything about your case that's going to be difficult? Theres a link below about peoples opinion on solicitors including mine which is that they're a waste of money unless your case is complex

I really appreciate your help! Our case should be pretty simple, I think. She is a F1 Visa holder in the US and I'm a US citizen. $1200 is the typical fee he charges. I think I'll go ahead with the AOS process without a lawyer.

So my fiance will need to change her last name in her social security card or driver license we want to open a joint bank account since our marriage certificate will contain her new name? I don't think the bank will accept the marriage certificate alone. If she changes name on some of her personal documents and not the other, while her AOS is in review, will she run into legal troubles? Thanks.

Hey Vubaru! You don't need to hire a lawyer for that.. I am a F1 Visa holder and my husband is a US Citizen.. We tied a knot last August 2009 and we filed for I-130 and I-485 concurrently last October 2009.. and now we got approved.. I'm just waiting for my GC to arrive by mail..

Since she's planning to use your surname. She has to inform the DMV, SSA, and of course the school. Just bring your original and a copy of your marriage certificate. For the passport, I still haven't change my surname on it. But I'm planning to once I get my GC. For the Bank Accounts, just the same, you have to bring the marriage certificate for the proof that you guys are married and also ID's..

Thanks for your help VJ users. I will go on without a lawyer. I think I'll buy my fiance a new laptop using my legal fee's budget :) I"m sure I have more questions when we start to fill out the OAS forms.

We also went to a lawyer and asked for his fee.. and guess how much he told us? $3,000.. Sounds crazy, huh?! VJ is really a big help to all of us here.. High five to all the VJ members! Maybe you can help me with this one too if you're familiar.

So my wife who's currently a F1 holder will also need to change her address while AOS is in review. I believe she will have to submit form ar11 and notify the post office, her school, and DMV. Is this correct?

Also, should she change her address first then the last name or we can just do these changes at the same time?
