Hello everyone,

I don't understand why my I-130 is still pending , it was mailed on May 21, 2009 ! we received NOA-1 in May 2009 !

they are saying CSC processing time is 5 months !! so we are 3 months behind the estimated time !! What shall we do next?

We called the USCIS 800 number, they keep saying its under processing!! call back in 2 weeks !!

I've seen people in this forum who file in september already got approved!! That really doesn't make any sense! :angry:

What actions can be taken at this point?

Does the USCIS 800 customer service have any extra information that what we see online?

4/4/2013. : Oath! Now a U.S. citizen!

Well there are few things you could do at this point. If I were you i would first start off the process by calling the customer service number and put a service request. You should tell them that your case is outside the current processing window therefor you need them to find your case and take an action on the petition. You can asked to talk with a supervisor also.

If this will not work , then you can also make an Infopass appointment to talk directly with a local immigration officer. If your case is pending because of security checks, talking to an immigration officer will not speed it up. but he could give you information regarding your file.

But at lease try to make them locate your file by calling the customer service number.

Hope your case will get approve soon.

Thanks for everyone trying to help me.

The case I-130 was filed on MAY 09 as LPR ,

then sent upgrade request in October 09 (USC).

Didn't hear from them re: upgrade --> sent an email after one month -> we got a reply on DEC 1 09 that the case is now upgraded to I-130 USC.

As far as I know, the file should be pulled immediately and work on my case since the receipt date was May 2009.

Today, we got another email as a followup for our case :: saying :: your case has been delayed because background checks are not completed.

I assume that USCIS initiated background checks on Dec 1st, 09 !!

I don't know how long does the background checks take? "I understand I'm from Saudi Arabia & this could prolong the process".

Is there anything I should do at this time?

WoW ! Unbelievable !! We received an email from USCIS on JAN 21 saying that background check is not completed and cannot move forward on your case and we have to wait 90 days before contacting them again!!
