HELLO FELLOW VJ'S I HAVE A QUESTION.I HAVE A FRIEND HERE SHE IS K1 HOLDER AND SHE IS ALMOST 1 YR HERE AND NOT FILING AOS YET.WHAT WILL HAPPEN IF SHE NOT FILE AOS?IS IT OK IF SHE NOT FILE AOS YET?ANY ADVICE THERE?THANKS

Ive read posts here in the forum that its okay if you filed late for AOS ... usually one just gets in trouble if you fail to lift conditions on time.. but make sure to tell your friend to file for AOS ASAP!!

although she is technically our of status, she won't get into trouble... unless she gets stopped by authorities for other reasons and then her immigration status is asked.

advice her to file as soon as she can.

I've also read there's no real consequence, as soon as the AOS is NOA1 the wife is legal status again and the time out of status will be forgiven during the AOS process.

The above poster is right, though. Your friend is technically out of status. If the couple were stopped by police for a normal traffic ticket or involved in a car accident or for some other reason her status in the US is called into question there could be problems.

I think I read about someone on this board having to push through the AOS process at deportation hearings for a case similar to this, but I think it worked out OK for them in the end. My memory is unclear, it was a long time ago I read it.
