hello All,

My dad is filling I-864 forms for his daughter's & son's (my bro & sis) families. My sis has (3) children & husband, my bro has (4) children & wife, so the total number of immigrants he is sponsoring is (11). He needs my help as co-sponsor to meet 125% poverty guideline.

1. My first question is since My parent are living with me, can I file I-864A instead of I-864 (because I think I-864A is much simpler).

2. And if I am eligible to file I-864A, where should do I list my own family members on I-864A form. I have my (2) kids & wife.

3. On I-864 form for my father, 21.g OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here.... What number should we put here (1) for only myself or (4) for all my own family members.

3. And since we are going to sponsor for (2) families, As I understand, My dad has to file (2) separate I-864 forms & I have to file (2) I-864A forms (1) for each family, please advise if I am doing it correctly.

4. My father is currently receive workman's comp and this income is not taxable income, so can he report this income.

5. And the last question, my dad is also receive retirement benefit through my mom's, so what is the option for him on part 6 (Sponsor income & employment). He quit working (6) years ago, after he got injured at work & not eligible for his own retirement benefit due to (4) credits shy of (40) for minimum requirement.

hello All,

If you mean your dad, yes, you can file the I-864A.

You would not list them on the I-864A - this form is pledging your income to help the primary sponsor (your dad). (so the combination of your dad's income and yours needs to be enough to cover your dad's dependents and all immigrants sponsored.)

Are any others submitting an I-864A? from what you posted - it appears to be (1) you.

Each person needs their own 864/A as needed. You can photocopy the signed original to make up the difference. (Copies may only be used for dependents whose names appear on the principal's original forms.)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, both my dad & mom.

Yes, our combined income will be enough to cover all sponsored immigrants (11), my dad, my mom & myself, total of (14). Does NVC count my own dependents when I summit them my tax documents. I file my tax Married filing jointly, so does my wife need to file another I-864A form. Just want to mention, I don't need to use my wife income to meet the guideline required.

No, Only me at this time

Yes

Since his work's comp benefit doesn't required him to file tax on this income. Does he need to prove to NVC?

Yes, my dad is unemployment. then I should choose option d.

He is also receiving retirement benefit through my mom's, should I choose option "C" as well?

I would just go with "retired".

About the number of copies.

yes, if the family is all on the same 864, one original for the first immigrant, and one copy the other immigrants listed for that one form.
