It has been said that they will make a copy of the medical results in the sealed packet when going through POE if we ask... is this the case and has anyone been given a copy? Just looking ahead since I am hearing of lost medical results along the way from POE to USCIS/AOS...

Hmm, wish I would have thought of that! Now I am nervous again about something I have no control over, thanks brother Scott haha. Oh well, well take it one day at a time, most important thing now is we are together, well deal with this if it happens! I tried to look when the officer was flipping through the pages to see what all was there. I could see all the original docs we sent with the I129F but could not tell what else was added at the consulate.

Good luck brother Scott and sister Thuy!!! Your day is almost here!!!

Thanks Bernie... I just got done talking to her and FedEx delivered the updated Timeline etc so she has everything she needs.... the rest is up to her and the CO... :unsure:

She is a little nervous because a girl she met at the medical called and said she got blue.. needed some extra documents... so thuy is going over everything with a fine tooth comb...

I am trying to focus on being ready for the next steps now... house is ready... the party is planned... after a few weeks to get adjusted to the time change we will be heading to Disney world and to see the shuttle go up...

You could certainly ask - they may even do it.

However, if by chance, you need to re-send in your medical (due to it being lost), you would still need to go to a CS to have them transcribe your copy to a new medical form.

Then they seal it so you can send it in for the RFE as needed.

But, if your bring in copies to your CS, they may not even do that - since you could of "tampered" with the original forms, prior to coming to them.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She has every right to ask for a copy of her medical exam even at the interview. Don't see why would you want to wait until POE to request something they can make a copy of for you at the interview.

Thats great news to know she received the timeline. I know its a little late now but I emailed mine to the consulate about two weeks before the interview, just before I left for Vietnam. I also received a confirmation email from them that they added it to her file. You know they never even asked for the original notarized copy at the interview. I wasn't sure if it was a good idea or not but I tried it and it worked. Maybe somthing for others to consider too, to get it in theor hands ahead of time. I heard so many people say they would not even take it at the interview.

I have a really good feeling about you two Scott. You have always been so great here helping others too and I just think you will see PINK. We are thinking of you daily and are with both of you in heart and mind. We will be eagerly awaiting news!!!!

She has every right to ask for a copy of her medical exam even at the interview. Don't see why would you want to wait until POE to request something they can make a copy of for you at the interview.

Where did you read that she has "every right" to ask for a copy of the medical at POE? She can certainly ask, but her request will be ignored.

I personally talked to CBP (the people in charge at POE) and the supervisor told me very clearly that they are not in the business of making copies for anybody. All those documents are sent to USCIS and you can ask for a copy to them, not to CBP.

Anyway, the FOIA allows you to ask for a copy of every file that the government has about you. Therefore, if you apply early (I think it is form 639), you can get the necessary information on-time for AOS (it may take between one and two months), if the government (USCIS) has such documents.

Hi Scott. The Panel Physician's Office refused to give me a copy of my medical or vaccination record. (Even though I paid for it. :angry: ) I explained the AOS immunization issue to the officer at the POE and asked him if it was possible to get a copy of the vaccination record. The officer very kindly made me a copy of the entire medical..... just in case I needed it, he said. :) I am very grateful to him.

Just found out the Hospital gave her some extra copies just in case... It took going through every piece of paper to know what she had....

The consulate specifically told me that my visa packet contained three copies of my medical and that I should ask the immigration officer at the PoE for one of them. At the PoE I said to the IO, after everything else (I-94, car importing) was done, "The guy at the consulate said that the packet contained three copies of my medical, and that I should ask you for one of them." He said "Oh? Why should you do that?" [He was a wee touch gruff through the whole thing. Spending 1.5 HOURS going through my file page by page probably does that to you]. I said, somewhat guessing "I think I need it for the adjustment of status process". "Oh, ok" he said, and gave me one.

The medical clinic had actually already given me a copy of the vaccination worksheet in a separate, non-sealed envelope. It wasn't marked DS-3025, and had an annotation "For Use only in Canada", so I ended up getting it transcribed to an I-693 at a local CS anyways. But it was interesting to get a copy of the full medical anyways.

The legalese on the release form I signed to have the medical done in Vancouver made it very clear that, regardless of who was paying for it, the medical is a service done by the civil surgeon for the consulate. NO doctor-patient relationship is created between me and the civil surgeon, and they are under no obligation to tell me anything about anything. The only disclosures they promise to make is alerting Canadian public health if I have certain diseases. And furthermore, if I have a problem with that I can take it up with the consulate or take a long walk off a short pier.

The staff at the clinic were, of course, much nicer than that, but their lawyers left me with no illusions about obligation to disclosure or any related rights.
