Hello fellow VJ's.

Can someone please tell me if my fiance from the philippines will need to get a quit claim from her daughter's father in order to bring her to the usa after we get married. The father is not on the birth certificate and has had no contact with the daughter who is three years old. Currently my fiance does not know where to find him in order to sign the quit claim. If we do need a quit claim, where can I find and example so that we are sure it says everything that it needs to say? Any help would be greatly appreciated. Thanks.

The short answer is NO... See the link in my signature...

The better answer is if you search the Philippine sub-forum (solo parent, single mother etc) you'll find several threads going into great detail on this subject.

The child is not property so no Quit Claim is required. If the father is not listed on the birth certficate, legally there is no father. Therefore nothing is required from a person that does not exist, namely the father. There is no father. Nothing is required.

Our case was the same.
