I'm not sure how long it, you can take a look at some timelines and check it. But I do know you have to wait for the 90 days before the 2 years or they will return your petition.

hello guys,

I was wondering how long does it take for my wife to change her 2 year conditional residency to 10 year permanent visa? And also, can we turn in the application a month early rather than wait until it is during the 90 day period?

If you send your application in before your 90 days then USCIS will kindly return it to you with a blue sheet asking that you resend it later. Therefore, there is no point in sending it ealy, unless you don't mind wasting time and money.

As for the time period, the CSC seems to be approving at a much faster rate. Many November CSC filers have been approved, but I'm not sure if even one October VSC filer has been approved yet.

thank you guys...the reason i ask is because my wife's visa expired on 28Oct2010...we have plans of taking a vacation in the philippines beginning 26Oct2010...and i think that's risking it if we buy our plane tickets now and then not being able to complete the whole process (new visa on hand) on time.

Since you are talking about your wife's visa . . . green card . . . I assume you are the US citizen. So, as a US citizen, please try to get your terminology in order.

Your wife does not have a visa. She had one when entering the United States, but now she has a Green Card (GC). The GC is the Government-issued document that grants lawful permanent residence (LPR) in the USA.

You will have to time the Removal of Conditions process (ROC) carefully. Generally speaking, about a week to 10 days after USCIS has received your package, and it appears to be correct and complete, they will send you a Notice of Action (NOA1). The NOA1 extends the duration of the GC for another year, meaning your wife's GC is now valid until October 28, 2011. With the passport and the NOA1 you can freely travel and return.

The "problem" is, that a few weeks after the NOA1, you will receive an NOA2, which requires your wife to attend a biometrics appointment. She cannot miss this appointment. Another "problem" might occur, if your I-751 application is not complete, and they don't issue the NOA1 before your vacation. The third potential problem is that some couples are called in for an interview and it's impossible to know if you are among the lucky ones.

Therefore, it would be smart to either take the vacation before your wife's GC expires, or after her ROC has been approved. This process is too important to jeopardize it for a vacation.

California Service Center is tracking around 2 months.

As for sending in the application, no, USCIS will not accept any application earlier than 90-days from the second residence anniversary. So don't send it a month earlier than the 90 days.

One last comment, and I think it is a typo, you are lifting conditions or removing conditions and you are getting your 10 year Green Card and not a Visa....
