If you were charged with assault, did you ever face those charges? If you didn't, I think you need to find out if they were dropped or if there is still an outstanding warrant for your arrest before you return to the US. Perhaps the friend you wish to visit can assist you with this by making inquiries. If you are listed as having an assault charge on your record that too may cause you problems. Your legal status appears fine in the sense that you would not have had an overstay and thus no out of status days. You just need to find out if there are any future repercussions from the criminal charges your wife brought against you. Good luck in getting it sorted out.

Thanks Kathryn41, all the charges were dropped in court as she took the Marital Privilege to get them dismissed so hope fully that shouldn't be an issue. Thanks to everyone else for the help too

I think that the VWP is concerned with just plain old arrests, regardless of the status of the charges afterward. You'll also want to know if what she had you charged with is on the list of crimes or moral turpitude or not.

Assault is listed as both a crime of moral turpitude and NOT a crime of moral turpitude, depending on the circumstances.

I think it would be a good idea for you to contact the US Consulate for your area and ask them specifically if, under these circumstances, are you able to use the VWP or do you need to apply for a visitor's visa. I don't foresee you having any problems entering the US under the circumstances as you have described them but you may be required to have a visa.
