So I see in the packet 4 for the k-1 visa that to provide evidence of support for my fiance I have to fill out the I-134 affidavit of support for him. I don't see anywhere though what the actual income guidelines that prove I can support him are on that particular affidavit. On I-864 I see some explanation guidelines (125% the poverty level and if we don't make it to 125% the poverty level then whatever difference there is I need 5 times that in assets). My question is, is these the actual guidelines for the K-1 visa or are the guidelines for the k-1 visa different? I would LOVE to find out that I only need to make 100% the poverty level for our family and that's it. It's really frustrating to me that the poverty line for a family 3 is 18,310, I make 19,465. yet 125% that poverty line is 22,887 which would mean that I would need over $17,000 in assets to make up for that (going by the I-864 that is). I really don't see how I could suddenly come up with over $17,000 in assets. I could get my parents to sign an affidavit of support but if at all possible I'd like to avoid it. Or if they do end up having to sign it because there's just no other way, does anyone know if I could sign documents later making me $100 liable for him as soon as I have the sufficient finances to show that I can fully support him?

Sorry for so many questions, I have just been so confused by all of this. ANY help would be greatly appreciated. It's so great talking to others that are or have gone through all of this mess!

10/5/09 - NOA1 sent

11/16/09 - request to expedite petition for humanitarian and medical reasons (I am pregnant with our baby due 1/22/10)

11/17/09 - request DENIED

1/7/10 - NOA 2 sent

1/13/10 - National Visa Center receives petition

1/22/10 - our baby is born right on his due date!

2/4/10 - make appointment with US embassy in Guayaquil

2/18/10 - I arrive in Ecuador with our little one, we meet up as a family

2/24/10 - Visa appointment with Embassy...Visa Approved!

3/10/10 - I fly back to the states

3/17/10 - He flies to the states

5/19/10 - We get married

10/10? - File for Green Card

1/6/11 - Green Card Interview - Accepted

Unless you're going to magically get a large raise, you're going to need to get a co-sponsor, a new job that pays over $23k-24k (the 2010 limits will be posted in mid-Feb), or a second job to make up the difference.

I wouldn't be surprised if the embassy won't approve a K1 when the evidence of support doesn't meet the 125% guideline and require that you get a co-sponsor, if not a new interview (and likely, new fee).

Technically, the I-134 only required 100% income , not the 125%. BUT because you will need to file AOS in a few months if the K1 is approved, and that requires the I-864 form, many consulates apply the rules of the I-864 in terms of assets. You'd be much saver getting a co-sponsor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

It's consulate dependent. I know for a fact that Brazil will not issue a K1 with an I-134 that doesn't meet 125%.

And some embassies don't accept co-sponsors. Without knowing where your fiancee is, we can't advise in this regard....
