Hello again,

My husband has filed for his visa and is awaiting the interview date and now we are wondering if we should have? He is a 1st Officer on a Mega Yacht and is not in the country that often. We just heard that he would need to be in the country for more then 6 months of the year or the visa would be taken. Is this true? Is there any way around this if so? The only reason we filed for the Visa was so that he could come in and out of the country without any hassles. We have been married for 2.5 years and have a 4 month old son. My husband is a British Citizen and I'm an American. Any help would be great. Thanks!

You are confusing a visa and legal permanent resident (LPR) status (the green card). If he's outside the country for a long period of time without having a re-entry permit he could lose his LPR status.

The USCIS web page is a bit unclear >> http://www.uscis.gov/portal/site/uscis/men...000082ca60aRCRD Other VJ members may have personal experience to share.

You may want to consult with a qualified immigration attorney as well to get professional guidance.
