I'd send it in with a cover letter & whatever your K1 documentation is. Send it in without the SSN & explain that he doesn't have one yet. That way you cover all your bases.

FWIW, I can't see how you would need to register. You're not an immigrant; you're a legal non-immigrant. Until you get your green card I can't see how you could be counted as an immigrant. IANAL, but I have worked as a paralegal & have read enough statutes to say that I believe your interpretation of the law to be correct.

Like anything else, one should always cover your butt. Wouldn't hurt in sending it in with explanation. Did u post this question on the k1 forum as there has to be others that have gone through this type of situation

Flames is probably right about the covering your butt thing...BUT, it's clear that you're considered a non-immigrant, and it's explicitly stated in the excerpt you posted from the SSS:

(i) is the fiancee or fiance of a citizen of the United States (other than a citizen described in section 204(a)(1)(A)(viii)(I) ) and who seeks to enter the United States solely to conclude a valid marriage with the petitioner within ninety days after admission;

That's you!

By the way, the 204(a)(1)(A)(viii) section refers to people convicted of abusing a minor...so I'm guessing that's NOT you! So you're free and clear.

That said, we sent it in this morning, and in my letter that I packed in with the registration, I explained that I was a K-1 non-immigrant but that I was basically sending it in to cover my bases, and that if I didn't need to register, that they should send me back a letter stating so. So I figure I should be free and clear either way.

I would call later on in the week to truly cover ur butt. As it can cause problems later down the road if you plan on applying for citizenship.

Just chipping in to say that this is the first I'd heard anything about Selective Service. Ever. I'm dead serious. I had no clue it even existed.

But from what I read on their website, it doesn't look to be something that will affect you. You're not a citizen or even a permanent resident yet. You're not even an immigrant, since the K-1 is a NON-immigrant visa. So as of right now, you are only a visitor to the United States, and it will remain so until you file for AOS. I think you might have had more to be concerned about if you were a Permanent Resident or a Citizen before your 26th birthday...but as it stands, I'm GUESSING (and be assured, it's just an educated guess) that you should be fine. I can't see why not.

In Montreal they told Sean that he has to register for Selective Service, and had him sign a paper saying he understood/agreed to this. He's 22 so he will have to do this.

Hmm...it probably specified after adjustment of status though, no?
