Proxy marriages are not recognized for immigration purposes.

I thought it was recognized if consummated. So even if they do it, USCIS will not recognize the marriage? Does she has to fill for fiancee visa then?

9 FAM 40.1 N1.3-2 Unconsummated

A proxy marriage, that has not been subsequently consummated, does not create or confer the status of “spouse” for immigration purposes pursuant to INA 101(a)(35). A party to an unconsummated proxy marriage may be processed as a nonimmigrant fiancé(e). A proxy marriage celebrated in a jurisdiction recognizing such marriage is generally considered to be valid, thus, an actual marriage in the United States is not necessary if such alien is admitted to the United States under INA provisions other than as a spouse.

...ok. so if i was not there my marrige is by proxy. there are diffrent customs diffrent countrys do things. this is so annyoing.

Typically in the West, people get married after they've met and probably without having family members as standing in place of spouses. Although this doesn't help you now, it's always a sound idea to have some reasonable understanding of the country and culture into which you are marrying to avoid potential problems such as the one you are describing.

Typically in the West, people get married after they've met and probably without having family members as standing in place of spouses. Although this doesn't help you now, it's always a sound idea to have some reasonable understanding of the country and culture into which you are marrying to avoid potential problems such as the one you are describing.

I am from and have the same culture as my husband. And we have meet and had are wedding. I only had to have my uncle stand in my place during the "legial wedding".

I understand the person you're responding to someone who quoted you but this is the issue when people come in and ask their OWN questions for a different situation, people get confused about who's who.

Hello everyone, I have some questions about the CR-1. My husband and I meet on the Internet We fell in love and got married June of 2009. We only got married by papers. We did not have a "Wedding". And i have never been to his country to meet him. We talk on Email. phone, on webcam everyday. and we know we love each other. But i dont know if i can file for a CR-1 becuase we have not had a wedding with a wedding dress and such. When he comes here we will have a small party with my family. But a wedding party is not important to us. I know when my case reaches the embessy in his country they will want pictures of are wedding. But we only got married on papers. I dont want to start it just to get denyed cuz we dont have pictures.

Yes, you consummated the marriage but I'm wondering about your marriage certificate--clearly it's not your signature on it, if you weren't there for the wedding ceremony. This is just my understanding and I'm sure someone more knowledgeable can chime in--but as far as I understand, your marriage certificate/marriage isn't deemed to be legal or valid for immigration purposes because it was a proxy marriage. But then again, I'm not a lawyer.

I know lots of people from my and my husbands town who did this and they were fine. It says that after the wedding is consummated it becomes legal.
