I am a USC living in Mexico. My husband (Mexican) and I got married in Mexico in 2008. We've been married for 1 1/2 years. We are starting the DCF process for the spouse visa. I am about to send in my petition for relative to Mexico City and I have all the documents I need. Just a bit confused about filling out the forms I-130 and G-325A. I need LOTS of help. My questions seem silly but I just don't want to fill the forms out wrongly to delay the process.

First which I guess is a silly question. It's easier to fill out the forms online and just print them out. However, alot of my info doesn't fit in the spaces. Should I print them out and fill them out by hand with black pen?

For the I-130 form:

Question 2 asks for my address. I currently live in Mexico and will be living here throughout the entire process. Do I put my address here?

It says to fill out ALL questions even if it's with N/A or None. Question 14A asks IF I'm a lawful permanent resident alien...so I put N/A. But then how do I answer 14b. that asks "Did you gain permanent resident status through marriage to a U.S. citizen or lawful permanent resident?" and only has 2 options Yes or No. I am a USC through birth.

Also, Question 17 asks about relative's children. We have a child together. Our child was born in Mexico but has her American birth certificate and passport. Do I list her in Question 17 or is it only for children that are not mine?

Question 22, If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:

Do I put Ciudad Juarez, Mexico?

On the g-325A instructions, it says not to fill out any information that is on the 1-130 for me. Is that true? Or should I fill it out completely anyway?

On my form when it asks "This form is submitted in connection with an application for:" Do I put Status as Permanent Resident? Do I put that for both mine and my husband's forms?

It also asks for my "residence" the past 5 years. I'm not a Mexican resident. I had an FM3 and now an FM2. Do I list my ADDRESSES for the past 5 years (all are within Mexico)?

PLEASE HELP! I'm getting very overwhelmed with everything.

Are you going to file it as a DCF? How long have you been in Mexico?

08/2006 met in GA, U.S.

05/2007 Antje had to go back to Germany

10/2009 got engaged in TN

12/31/2009 got married

1/7/2010 I-130 sent

1/9/2010 I-130 delivered

1/13/2010 check cashed

1/15/2010 NOA 1

3/18/2010 NOA 2

Also understand the DCF in Mexico is a bit different than most every place else, as you can submit the I-130 to the USCIS foreign field office (Mexico City, CID or Monterrey), but the petition will eventually end up at NVC for that part of the processing.

I-130 questions:

address: I have seen that some people here have said they put their foreign address. I've been meaning to do more research about this.

Questions 14 & 22: Both have instructions saying only certain people should answer them.

The child question: I don't know, but I don't know why you wouldn't list your child.

G-325:

I'm sorry I can't understand your first question.

Submitted for: I have seen "Other - I-130" listed on this site. I was going to try "CR-1"

In the address part it is asking for your addresses for the last 5 years.

Also, be aware that as a US citizen doing DCF they will expect proof that you are re-establishing domicile. If you don't have any US income, you might have to look into a co-sponsor in the US unless you have enough assets.

April 19, 2010 - NOA1 (documents received at Mexico City Embassy)

April 20, 2010 - NOA2 (received notice April 28, 2010, mailed April 27)

May 3, 2010 - Packet 3 sent (received May 27, 2010)

May 9, 2010 - I emailed them using the inquiry form asking for my case number

May 17, 2010 - received case number and link to Packet 3 by email

May 18, 2010 - sent Packet 3 to Ciudad Juarez

May 28, 2010 - called Ciudad Juarez to see if we had an appointment yet, they said wait 6-8 weeks :(

May 30, 2010 - I return to the US

June 8, 2010 - called and found out appointment date

June 16, 2010 - received Packet 4

July 6, 2010 - interview - Approved!

July 7, 2010 - pick up visa at DHL and POE to activate

July 29, 2010 - welcome letter received

August 1, 2010 - my husband comes home to me

August 13, 2010 - received Green Card

September 28, 2010 - never received Social Security Card, had to apply for it, arrived Sept. 28

1. For I-130: Where does it have the instructions that only certain people should answer Question 14 and 22? i can't find it.

2. For G-325A: What I read was this:

"D. A completed and signed Form G-325A, Biographic

Information, for you and a Form G-325A for your

husband or wife. Except for your name and signature

you do not have to repeat on Form G-325A the

information given on your Form I-130 petition."

Is that true or should I fill out the whole G-325A form anyway?

14. If you are a lawful permanent resident alien, complete the following:

22. Complete the information below if your relative is in the United States and will apply for adjustment of status.

2. G-325a:

a. I looked over the I-130 instructions yesterday and saw what you are talking about. I filled out everything in the G-325a anyways. My guess is they mean that if you already gave information in the I-130 you don't have to repeat it, but this is the government and they are not too organized. I have never heard of anyone not filling out parts of the G-325a.
