Hello,

After filing my I-751, I did the biometrics twice and my fingerprints were rejected as illegible. I got an I-797 notice of action asking for a certification of good conduct for every district I lived in for the past 5 years. I've lived in LA for 4.4 years and can get done done in person, but I also need one from Chicago because I lived there before moving to LA. I called the Chicago Police Dept. and they said I need to do it in person, which would be very hard to do. The receptionist put me through to her supervisor and I left a message, but I don't know if she'll reply.

Has anyone been in this situation? I can't really afford to fly to Chicago.

Hello, I am in the same situation : fingerprints rejected twice.I have not received the NOA for police clearance yet. As you did already receive it,do they ask police clearance for the last 5 years in all places where you lived within the U.S ? or they did not specify "within the U.S" ?

As I lived in France in the first of my last five years, I need to get it from france. Thanks for your reply

Hi there,

This is what the NOA says: "Please provide a letter issued by the local law enforcement agency (County Sheriff's Office or Local Police Dept.) indicating the applicant has "no criminal record." The record search should include all the aliases (all other names) the applicant may have used in the past. A separate letter is required for each law enforcement district in which the applicant has resided during the previous five years."

I'm not sure if you need to provide a certification of good conduct from France. I've been outside of the US for 2 months now, but I don't think I need to provide a certificate from the country I'm in. I may contact a lawyer I consulted a while ago in the US. I will let you know if I do so.

Going back to my original question, I called the Illinois State Police and you can request a certificate of good conduct by mail. I wouldn't have to go there in person.

Hello Ivalleh, Thank you for taking time to reply to my question.The reason I mentioned about police clearance of the country outside the U.S that you lived in the past 5 years because I read it on a lot of different immigration websites...and if it is true, it is more complicated, because once I have it, to have to have it translated from french to english !. I would be great to hear from your lawyer about this matter.Please let me know about the answer.

Please,let's update each other on our situation and good luck to you for the process.How long since the 2nd biometrics date for you to receive the NOA stating that you need police clearance ? They asked you to send to the USCIS by postmail or to bring to local field office ? did you receive a letter asking for interview ?

I got the same RFE for the same reason. I have only been in the US for 1.5 years when I received that. So, I went to the local PD here and got the police background check (paid $5 and waited 5 minutes) for the 1.5 years that I have been here. I didn't move to a different county so I only needed one. I sent that in to USCIS and got my case approved the same week! They don't need your police clearance abroad unless it clearly says so.

According to your timeline, your process concerned I-485 (AOS), you didn't have an interview before they adjudicated your case ? so you just sent the police clearance to the USCIS Center that posted you the RFE ?

Yes indeed, I checked out your timeline and would like to ask you this : did they specify in the RFE how much time they gave you to send the document they requested ? because I will be out of the country for one month from next week and I have not received the RFE yet.My last bio. was on 01/19/2010. The RFE notice date says Dec. 23 and I was given until March 17 to send the evidence, but I don't know if they give everyone 2.5 to 3 months to send this in. It's great to know you don't need a certificate from abroad. I was looking into requesting one.

My AOS case was transferred to California so no interview was required. I was approved a few days after I received the update that my response was received and case was resumed.

The RFE letter was pretty much self-explanatory. You will find instructions as to where to send the response to and the deadline of the RFE. Let me know if you would like me to scan my letter so you have an idea.

I received the online update about the RFE on 11/5 and got the snail mail on 11/10. In the letter, it says "You are given until December 17, 2009 in which to submit the requested information to the address at the bottom of this notice" The RFE was pretty easy to obtain so it didn't take me long to send it back to them. Just a note, over here in North Carolina, there are two types of criminal background check: (1) A simple piece of paper that says that you do not have any criminal record - cost around $5 and takes 5 minutes at the local PD; (2) A more detailed criminal background check which is around 4-5 pages long and can be obtained only from the Court House, takes a couple of weeks and costs more. You only need type (1) which is good! Also, I gave the officer at the PD both my maiden and married names since the RFE says "The record search should include all the aliases (all other names) the applicant may have used in the past"

Very helpful information here. I, too, am looking forward to this RFE! It's been a month since my second bio and I'm tired of the daily mail anticipation :)

My AOS case was transferred to California so no interview was required. I was approved a few days after I received the update that my response was received and case was resumed.

The RFE letter was pretty much self-explanatory. You will find instructions as to where to send the response to and the deadline of the RFE. Let me know if you would like me to scan my letter so you have an idea.

It's been a while. I just wanted to say that I requested the police background checks or "certificates of good conduct" as USCIS calls them from the Illinois State Police and from the Los Angeles Sheriff's Dept. (the simple background check with no fingerprints) and sent that to USCIS together with other evidence they requested. I sent this on March 10 and they issued my green card on March 16. They also mailed it right away on March 19th. So, as NCWife said, you don't need a certificate of good conduct from abroad.

Finally got an email from USCIS. Said they are ordering card production. Awesome.
