Hi,

On the guide provided here it says to get your SSN 2 weeks after entering the US in order to make sure you are on the system, then get married.

However, is it possible to get married, then apply for your SSN afterwards, before doing the AOS? Alternatively I believe if I didnt get a SSN while on my I-94 from the K-1 visa I would have to wait till i got my EAD?

It is possible to marry and then get an SSN (needs be applied for before day 76 of entry), but many SSA offices struggle with this concept as well as the name change that can occur to a female alien.

We got married 2 days after her arrival here (Dec 31). We applied for her SSN the very next week.

No need to wait for any of the above - the marriage certificate entitles her to an SSN.

a marriage certificate is not the document that entitles a person to be eligible to apply for a SSN

She also showed her passport & K-1 visa. That was all she showed and they processed her

with no problems. We had to show the marriage certificate because that showed the name under which her SSN would be created. If she applied for the SSN without the marriage certificate she could have done that before the marriage, but then if her name changed upon marriage that would have to be registered with the SS office.

but it was the K-1 visa and the unexpired I-94 (with a minumum of 14 days remaining before expiration) that were the documents that entitled her to apply for the SSN... the marriage certificate is to bridge the gap from the name the USCIS has recorded and the name the SSN is to be issued. Your experience is exactly how it is suppose to work, unfortunately not all SSA offices are properly informed on how it is suppose to work.

I was glad they overlooked the fact that her name on the I-94 was misspelled; it will be

corrected in any case.

Since, I'm assuming you aren't going to be changing your name after getting married, waiting a little longer to apply after you are married probably isn't going to matter. However, since you aren't going to be changing your name why would you want to wait? If you do apply after getting married, ditch the wedding ring and don't say anything about being married. Try to give yourself at least 6 weeks before your K-1 status expires to apply. That will give you time in case the SSA office has trouble verifying your immigration status.

I don't think most people wait for the SS# and then get married.

I got married first and then the SS# she went 2 weeks after she got here and she wasn't in the system, but was in it 2 days later.

It's a mix. As K-1s, some people apply before getting married and some apply after. The only time it doesn't make any sense to apply after getting married is if the man is the K-1, since I would assume 99.99 percent of the time the guy isn't changing his name. For a woman it's a personal choice, but I would apply as soon as possible and worry about the name change once you are married and have an SSN.

Okay, this whole marriage/ssn thing is the next on my check-off list.

What is needed in order to apply for a marriage certificate? I thought you had to have a ssn. At least the one from my county has a place for a ssn- or will the k-1 visa stamp be enough?

That said, how long does it take to get the ssn?

If it doesn't matter, I will get married first! Not waiting anymore if I do not have to! :D
