Hi,

If I have my I94 expired can I still be in legally in the US?

Depends. How did you enter the country, with a Visa or under the Visa Waiver program? If a Visa, which type? Are you married to a USC?

OK. I looked at some of your other posts to guess your status, and it looks like you filed I-130 and I-485, so yes, you are still legally in the country, despite the fact that your I-94 has expired. Your ability to remain here is assured by the fact that you have applied for AOS.
