Hi,

As I've posted earlier, my husband and I have our AOS interview this Friday. Because we got the appointment so quickly, my husband hasn't yet had his EAD approved. If our interview is successful but we are told that his background check is still pending (which I suspect will happen), what happens to his EAD application? I guess I'm wondering if AOS interview is independent of our EAD application and if he could still get approved for his EAD while we are waiting for his background check to be completed. Anybody know? Hope this question makes sense!! :wacko:

i dont think they will issue the EAD anymore, if your case has been approved i guess next step is wait for green card.......

considering how fast you got the interview, im sure green card cant take that long after name check.

congratulations i think you have the record so far :)

Yes, the EAD and AOS are independent of each other, but if he gets approved at his AOS interview, then the EAD is no longer necessary. If he is not approved, due to the background checks, at his AOS interview, then his EAD application will still be in processing. It isn't that often that the AOS is approved before the EAD, but you might just be lucky and get the AOS approved first.

Thanks for your responses. Sounds like you are saying that if a background check hasn't been completed, then we couldn't be officially "approved" even if everything else is in order and therefore, our EAD application would still be in the processing stage. I guess I'm just trying to prepare myself for all possible outcomes after our interview!

We filed my husband's AOS application and EAD in March. He had his AOS interview on May 9th, and was approved pending the background check. He received his EAD on May 26 and his AOS application has been "touched" in June and July but still no word on his Resident Card.

That's good to know about the EAD anyway - sounds like your AOS status went pretty fast too.....at least in the beginning.....
