New to CR1, please help

Hi,

I am new to CR1 process, initially was thinking K3 visa process will be quicker, until someone mentioned in the forum that CR1 is quicker.

Can someone please help me in understanding the CR1 visa process, from where do I start? What forms, documents are required for me to apply for this process.

I am a US Citizen and got married outside of USA to citizen of India, haven't yet filed for him, as I did seek Attorneys help in this matter for applying K3 visa, though was expensive process through attorney, thought process will be faster through attorney. Until I posted on VJ forum, someone suggested to apply CR1 visa.

I am confused as to what to apply, how can i apply and what forms that I require for me to apply for him. I am totally new to CR1 process. Can someone who have been through this process, please help me.

My husband is not here with me and require everyones help, inorder for us to be together soon.

Please help, I seek everyones help in VJ forum.

Appreciate everyones responses.

Yes, the CR1 visa is a much better visa, at times faster than a K3 but not always but only by a month or two. Why is it a better visa? Well, for one like I said the processing time is not that much different. Also, with a CR1 visa your husband will get his SS card and green card in the mail a few weeks after arrival to the US. A K3 visa will only allow him to enter the country and then you'd have to file for Adjustment of Status, pay another $1,010 and wait between 3-6 months for a work permit or 6+ months for his green card.

You can find how to apply for a CR1 in the Guides. That's what I used and what most people have used without any issues whatsoever. They're very thorough and to the point, so you won't be lost if you follow the instructions.

The guides here are your friends... Fill out the I-130, get your BirthCertificate, Marriage Certificate, translation of the Marriage certificate and any other documents and you send them off the NVC with the $, then you are off and running on the first part...

It may when you get to the NVC and have to file the Affidavit of Support. You may need to get a co-sponsor, depending on your income. It won't affect the initial I-130 part, so you should go ahead and get that underway post haste. It will likely take USCIS 1 to 5 months to process that before it even goes over to NVC, so much could happen in the intervening time.

Please I am lost in India they have given us the royal run around and I have to go home to Wisconsin at the end of the month I have been so ill here as I have been here since August and the embassy lead us to believe we could file in Delhi and then on the 31st of Dec. they said no I have to file in USAI can Fed x the papers before I leave but I want to do the CR1 and I do not have an idea. Please help us. I am much older then my husband and he acts older then me. We want to be together as soon as possible PLEASE HELP US

I think you do not qualify for the Direct Consular Filing (DCF) of the I-130 petition. There's a residency requirement - you must live in India for a certain period of time, prior to filing.

As to 'fed ex the papers' - well - if you want to file for I-130, the normal way is 'to the lockbox in Chicago' .

If you are leaving at the end of this month, though - I'd take the opportunity, now, to put together a COMPLETE I-130 package, complete with bonafide marriage evidence, and then fill out (but not send yet) the DS-230, getting all of your wife's documents . Then when you return to USA, file the I-130. But that's just my opinion - other folk will have other opinions.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
