Timeline

I did received a latter last night from USCIS they denied my cause for my wife AOS

I need some help please about what to do? Me and my wife we just had new baby about 5 month a go we do leave together in Florida for the last 2 years.

Does any one know a good attorney in Pembroke Pines or Miami area?

I am so worry right now and confused about what to do help me please .

What was the reason it was denied?

From what you write, could it be they didn't think you were a genuine couple? If so, what evidence did you submit?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

CR-1 Journey - California Service Center

I-130 timeline:
I-130 NOA1 - 05th Nov, 2009
I-130 NOA2 - 10th February, 2010 Yay!!!!
"Your I-130 was approved in 97 days from your NOA1 date."


NVC Journey:
02-16-2010: NVC Case # Assigned
03-31-2010: Case Complete!!
04-12-2010: Interview date assigned by NVC.
05-11-2010: Medical appointment in Rio

05-13-2010: Interview in Rio - APPROVED!!!

06-02-2010: POE in Washington DC - Finally home!

July 30, 2010 - Received the Green Card after receiving 4 welcome letters! USCIS see ya later!

2 YEARS LATER......

03-02-2012: Elegible to lift conditions
06-02-2012: Temporary GC expires

12-20-2012: Permanent GC received

6 MONTHS LATER......

06/03/2013: n400 Filled

10/22/2013: Citizenship test and oath ceremony

A baby doesn't necessarily amount to the end all as far as adjustment information goes. What did the letter say exactly, please.

they denied my AOS Because they received my AOS application one day latte. They receive the application an august 7 2009 and the last day was an AUG 8 but I mail the application before the died line.

What visa did you use to come to the US?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Ok - when was the CR-1 visa issued, when did you enter the US?

If you're here on a CR-1 then you never had to adjust status as your status was always Immigrant and you were issued a Greencard when you activated the CR-1 Visa at your POE.

Are you talking about being denied for Removal Of Conditions? That would make a lot more sense.

Exactly.... should have filed the I-751... I hope they did not file the I-485 as that makes some sense why it would be denied

Even if they did file the proper paperwork for Removal of Conditions, if it was received by USCIS after the Conditional Greencard expired then they are SOL as USCIS makes it very clear the ROC Application MUST BE RECEIVED PRIOR TO THE EXPIRATION OF THE CONDITIONAL GREENCARD which is why we are given a 90 window BEFORE this date to apply.
