Anyone waiting for rebuttal please share..

Hi all,

I just want to check the time frame for rebuttal at VSC. My case was sent back on March 09 and currently pending at VSC. I dont know how long it will take for VSC to give me a chance to rebuttal.. I am thinking refile for I-130 but I am afraid it will get denial again at HCMC. If you are in the same situation please share your timeline.. thanks

my wife failed the interview on Nov 7, 2008. our case file was sent back to NVC and USCIS (Cal Service Center) received the file in late March 2009. USCIS mailed the Notice of Intent to Deny letter in July 2009 giving me 30 days to rebut. I sent my rebuttal to them and they reaffirmed my petition on Sept 2009. My wife received packet 3 in Nov 2009 and we faxed form DS-230 and DS-2001 on Dec 14, 2009 to the consulate. They confirmed receipt of the forms via email. Now we're waiting for an interview date.

VSC and CSC don't handle returned cases the same way. If someone had a case return to the VSC , maybe they can chime in to help you out more than someone who went through the CSC can.
