Hiya VJ Members..

I need you help very badly...

my AED will soon expires.. I have been thinking what to do, though I do know what to do but I couldn't find a renewal forms..

i have a very complicated story and to make it short, I got married and didn't work out and he did withdraws the AOS petition but before that I was able to get my AED..

i was able to get a job right away and I am no longer with him, i lived at the shelter for 3months before I was able to start getting back my feet..

my job did helps me and am on my proccess of divorce and also working on my immigration papers with a probo immigration attys.. my divorce atty is also a probo, all provided with the court here in ADA COUNTY..

my immigration atty is working on my case but it is just bugs me that few months from now my AED will expires.. my immigration case is so slow but i am fine with it till 2010 comes and it start to boils me so badly...

am confuse of what is the right thing to do and i have this thought at the back of my head that I will just get a renewal form and do it by myself, VJ members can you pls help me out on this very sensitive complicated situation of mine, pls?!

I do need your inputs and suggestions.. thanks.. I am an existing member but i couldn't access to my old one for i totally forgot everything so i created this other acct hoping I can find some answers...

AED = automated external defibrillator. EAD= Employment Authorization Document

So you got married, received the EAD and then left your husband? Correct me if I'm wrong, but if that's the case I have no idea how you could "fix" this situation as you really have no legal standing... You were adjusting status based on your marriage to a USC, your husband withdrew his support of your adjustment so you're probably now out of status. If you completed the AOS process you would've received a conditional green card which would have replaced the EAD (they almost always take the EAD from you during the AOS interview). Don't let those attorneys take you for a ride and take what money you have left. What are they advising you to do or what are they saying they're gonna do for you to help you? VJ'ers are very clued up on immigration law, if you write here what your attorneys are telling you people on here will definetely be able to tell you if they're lying/robbing you or not.

hmmmm....what gives you the right to renew the EAD if there is no more AOS pending based on marriage with a USC?

I advice you to have your attorney/lawyer explain to you the logistics behind your case. I feel that he/she is taking advantage of you. There is NO WAY to renew your EAD if you don't have a pending AOS. Once you divorce-and you already did it-your AOS application is ZERO.

Hi Guys,

sorry to just now replying,,. it is been a while i haven't had a chance to get back here in vj due to connection issues and was so busy for other things too..

after posting this thread, i did found out that AED under K - 1 is no longer renewable!!

and so, I emailed my probono immigration atty and so as my probono divorce atty.. my probono immigration atty replied back the following morning, that night that i posted this thread.. I didn't slept well and was up till past 2am and woke up 7am.. geez, it was really a hard day for me..

as what I have said that my situation is quite complicated and for you guys to understand more,,.. I will explain further..

I didn't really left my soon to be exhusband.. he was arrested May of last Yr and that was the last time I saw him.. I stayed one wk at my friends house before I xfere to a shelter which I stayed for 5month before I started to got back on my own feet..

that day that he was arrest for the charges he was facing, i got so much great help from the police, courts and my friends..

he did pledid guilty of the charges that was fileD against him which was "DOMESTIC VIOLENCE and FALSE IMPRISONMENT".. and the COURT ordered "NO CONTACT ORDER FOR TWO YEARS" and he is on "PROBATION"...

so there, that explains that I didn't left him. I was on the sitaution of Voilence..

I do know that I am out of status but not really yet for I still have a valid EAD though it will expires soon...

the moment he found out that I was working, that is where he withdraw the AOS...

my attorneys are PROBONO and they aren't robbing the last penny I have for they are both PROBONO..

My PROBONO Immigration Atty told me that I don't have to get PANIC for Her and I won't ask to renew my EAD but instead we will asked a NEW ONE - we will start from scratch to ADJUST MY STATUS; and that is UNDER VAWA CASE... is it all clear now Guys?!

By Monday, I will under go a Medical Exams, a background/health checks from the Police and by Feb. I will gonna be at my Immigration Office to sign bunch of documents..

Once Again Guys, thanks for all your inputs on this matter..

It sounds like you are in good hands now with your lawyer. She will help you get a new EAD with your VAWA file - and it sounds like you have good evidence to prove VAWA with your soon-to-be-ex husband jailed for the offense. Good luck to you.

I'm sorry to hear about your situation, but it does clear up a lot of the misunderstandings of your case. I'm glad you are getting out of the bad situation and have support from friends, family, and others. I wish you the best as you go through starting a new AOS journey for yourself. :-) Sounds like you are in good hands.

Reminds me a Whole lot of the story of Anastasia King and Indle King, see below. Get as far away from this guy as you can, good luck with making a better life for yourself.

In 1999, 18-year-old Anastasia Solovyova married Indle King, a man she met through an IMB. Entries from Anastasia’s diary detail the abuse she suffered and the fear she had of her husband who threatened her with death if she were to leave him. In December 2000, Anastasia was found strangled to death and buried in a shallow grave in Washington. King’s accomplice later told police that he strangled Anastasia with a necktie while King lay on her chest to keep her from moving. At trial, it was discovered that Indle King had previously married another woman he met through an internet IMB, who later got a domestic violence protection order against him before divorcing him in 1997. It was also discovered that he was seeking his third wife through an IMB when he and his accomplice developed the plot to kill Anastasia.

Just got time to access here again.. as usual pretty swam up with so much overwhelming things around me..

Just this Monday, I did have my Medical Exam for my Immigration Stuff, I have to redo everything for I don't have my medical records with me, my soon to be x- husband has all my records and he is holding it!! ugh!! I detest Medical exams - the physical exam is quite embarrassing + the pain of needles! huh?! second needle was more painful than first and I couldn't help myself not to cry, ouch! and it cost me most of my paycheck! ugh!! whew! then I have to take a passport picture also and send it to Immigration Atty by Tuesday, I will sign bunch of papers too..

I hope that all this pains I have been through and this struggles that I dealt with has a good pay off - I am still scared and worried of what will be the outcome? but I am offering it all to god for I do believe that everything that happens to our life has a purpose, right?!

thanks to all you guys, I would like to say one by one all your usernames but I am in a hurry for got to go to bed now for work early tomorrow and it is snowing pretty hard here and I am riding my bike for no buses during weekends.. and before I go, I attached here with my affidavit.. this tells everything what happened my life with my soon to be ex - husband.. just wanna share it to you guys here..

guys, thanks and thanks so much for all your replies and inputs.. i do really appreciates it..

today, I did have a meeting w/ my immigration atty and signed bunches of papers and hopefully, by friday she will send the packet to MSC..

she is waiting for the background check result from the sheriffs and a document from my divorce atty about my divorce proccedings..

and tomorrow, I will put on the mail the add'l passport pics - my immigration atty forgot to tell me needed four but anyways - i got that taken

care of when I got home today,,, I had a very tiring busy day - so hard to chase buses and waited for 3.5 hrs for another bus to come and take

me back to the city where I live in..

My immigration atty told me that there is no assurance of everything but with all the proof of evidence that the marriage was BONAFIDE and with

the pled from my soon to be xhusband "guilty" it is a strong case of VAWA.. as you guys reads the attached doc(now deleted) it was all stated

there how did my life went through while I was with him... huh?!

on the other hand, it will take 90days - as usual to know what is going on and still am so worried.. but I am optimistic that I will be granted for

a new EAD and hopefully GC in GOD's will..

lastly, thanks alot again.. gotta dash now for bed - my back is killing me.. ugh!!

I read your affidavit before it was deleted, I was definetely shocked to say the least, I'm guessing the reason it was deleted was because you forgot to delete All the names in it (including ex husband) not a good idea on such a public website and since he's not here to defend his name it's best to not reveal his name on here. But your affidavit really hit home to me how some new foreign wives can be at the complete mercy of their new husbands and how badly things can go wrong, maybe delete all the references to names/addresses/personal information and post it again, you could potentially help someone else going through the same situation or even those thinking about taking a leap of faith to join their new husband in a foreign country.
